AN ORDINANCE AMENDING CHAPTER 21 MASSAGE ESTABLISHMENTS
OF TITLE 3 BUSINESS AND LICENSE REGULATIONS OF THE VILLAGE
CODE BY DELETING PROVISIONS REGULATING INDIVIDUAL MASSAGE
THERAPISTS
WHEREAS, the State of Illinois has adopted the Massage Licensing Act which
became effective January 1, 2005, which Act licenses massage therapists in the State of
Illinois; and
WHEREAS, said Act precludes individual municipalities from regulating massage
therapists but does permit individual municipalities to regulate massage establishments
located within their jurisdiction and boundaries; and
WHEREAS, in light of the provisions of the Illinois Massage Licensing Act, it is
necessary for the Village of Elk Grove Village to amend the Section of the Village Code
pertaining to the licensing of massage establishments and massage therapists, which
provisions are set forth in Section 3-21-1 et. seq. of the Elk Grove Village Code.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees
of the Village of Elk Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That Chapter 21 Massage Establishments of the Village Code of the
Village of Elk Grove Village be amended as follows:
That Section 3-21-1 Definitions be amended with respect to the
definition of Certified Massage Therapists to read as follows:
Certified Massage Therapist — An individual who has been
issued a Massage Therapist License by the State of Illinois
Department of Financial and Professional Regulation.
2. That Section 3-21-4 Fee pertaining to license applications be amended
to read as follows:
C. The application for a license to operate a massage
establishment shall state the name of the individuals who have
been issued Massage Therapist Licenses by the State of Illinois
Department of Financial and Professional Regulations and who
will be performing massage therapy on the premises. No
massage establishment license shall issue to any establishment
whose therapists are not licensed with the State of Illinois.
3. That the following provisions of Chapter 3 are hereby repealed:
3-21-7 Requirement of Employing a Certified Massage Therapist.
3-21-8 Certified Massage Therapist and Massage Therapist in
Training License.
3-21-9 Application for Certified Massage Therapist License and
Massage Therapist in Training.
3-21-10 Issuance of Certified Massage Therapist or Massage
Therapist in Training License.
3-21-11 Revocation of Certified Massage Therapist or Massage
Therapist in Training License.
3-21-14 Outcall Massage Service.
3-21-17 Identification Card Required.
4. That Sections 3-21-18A and 3-21-18C be amended by deleting any
provisions with respect to Certified Massage Therapists and Massage
Therapists in Training.
Section 2: That this Ordinance shall be in full force and effect from and after its
passage and approval according to law.
