A RESOLUTION AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE AN
AGREEMENT FOR PHASE 2 ENGINEERING BETWEEN THE COOK COUNTY HIGHWAY
DEPARTMENT AND THE VILLAGE OF ELK GROVE VILLAGE (DEVON AVENUE AT
BUSSE ROAD, AND LANDMEIER ROAD AT BUSSE ROAD)
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DUPage, State of Illinois as follows:
Section 1: That the Mayor be and is hereby authorized to sign
the attached documents marked:
AGREEMENT FOR PHASE 2 ENGINEERIN(
DEVON AVENUE AT BUSSE ROAD,
AND LANDMEIER ROAD AT BUSSE ROAD
a copy of which is attached hereto and made a part hereof as if fully
set forth and the Village Clerk is authorized to attest said
documents upon the signature of the Mayor.
Section 2: That this Resolution shall be in full force and
effect from and after its passage and approval according to law.

PHASE 11 AGREEMENT
THE COUNTY OF COOK
VILLAGE OF ELK GROVE
LANDMEIER ROAD
AT BUSSE ROAD
SECTION: 01 -A6817 -02 -CH
This Agreement, made and entered Into by and between the COUNTY OF COOK, a body politic
and corporate of the State of Illinois, hereinafter called "COUNTY", and the ViLLAGE OF ELK
GROVE, a body politic and corporate In the State of Illinois, hereinafter called "VILLAGE".
WITNESSETH
Whereas, the COUNTY and ViLLAGE, in order to facilitate the free flow of traffic and ensure the
safety of the motoring public, are desirous of constructing an Improvement of the Intersection of
Landmeier Road at Busse Road, characterized as the installation of dual left turn lanes on all four
approaches of said intersection and other attendant highway appurtenances (hereinafter called
"PROJECT") and said PROJECT is herein designated as County Section: 01 -A6817 -02 -CH;
Whereas, the VILLAGE and COUNTY established terms for the development of PROJECT
construction plans for the Intersection of Devon Avenue at Busse Road In a Letter of Understanding
dated August 26, 1999 and accepted by the VILLAGE on September 14, 1999; and,
Whereas, the VILLAGE has completed a Phase I Study, at Its expense, for said Intersection, the
COUNTY has reviewed said Study and the VILLAGE has received Illinois Department of
Transportation approval of said Study on August 9, 2001; and,
Whereas, the VILLAGE Is desirous to start Phase II Design Engineering for the PROJECT, has selected
a design engineering consultant, Civiltech Engineering, Inc. and the Letter of Understanding calls for
sharing of Phase II engineering costs between the VILLAGE and the COUNTY; and,
Whereas, the COUNTY and the VILLAGE, by this Instrument desire to determine and establish their
respective responsibilities toward engineering, construction, funding and maintenance of the PROJECT.
Now, therefore, in consideration of the mutual covenants contained herein and the above recitals and
other good and valuable considerations, the parties hereto agree as follows:
1. The VILLAGE shall:
a. reference all correspondences, plans, bills, invoices and other documents for the PROJECT
withCOUNTY's Identifier SECTION: 01 -A6817 -02 -CH:
b. submit the Phase 11 Design Engineering contract to the COUNTY for review;
c. have Its consultant conduct Phase II design engineering and prepare PROJECT construction
plans, specifications, estimates and contract documents (estimated cost $130,000) and
obtain COUNTY and State of Illinois approval of final plans, specifications, estimates and
contract documents; and,

d. pay for seventy (70%) percent of the Phase II design engineering costs and bill the
COUNTY for thirty (30%) percent of said costs in two (2) installments: the first
Installment, $20,000.00, thirty days after COUNTY concurrence to the design
engineering contract, and the remaining balance, following State of Illinois approval of
completed plans.
2. The COUNTY shall:
a. review the Phase II design engineering contract for adequacy and acknowledge its concurrence
for same to the VILLAGE,
b. review and approve final plans in a timely manner; and,
c. pay thirty (30%) percent of the costs of Phase 11 design engineering (estimated $39,000.00)
In two (2) installments according to I .d. hereinbefore.
3. The COUNTY and the VILLAGE further agree that their respective successors and assigns shall
be bound by the terms of this Agreement.

of an Improvement Resolution approved by the Cook County Board of Commissioners at their
meeting of January 24, 2002, all of which appears from the records and files of my office.
RESOLUTION
BE IT RESOLVED, by the members of the Board of Commissioners of Cook County, Illinois,
on behalf of the County of Cook, to authorize and direct its President to execute, by original
signature or his authorized signature stamp, two (2) copies of a Phase II Engineering Agreement
with the Village of Elk Grove Village, attached, wherein the Village of Elk Grove Village will
direct the preparation of construction plans and specifications for an improvement of the
intersection of Landmeier Road (County Highway A 68) at Busse Road; the County of Cook will
pay thirty (30%) percent of the Phase II engineering costs (total estimated $130,000.00) under
County Section: 01 -A6817 -02 -CH (County estimated cost $39,000.00); and, the Department of
Highways is directed to return one certified copy of this Resolution and the executed Agreement
to the Village of Elk Grove Village.

obtain COUNTY and State of Illinois approval of final plans, specifications, estimates and
contract documents; and,
DEVON AVENUE AT BUSSE ROAD
Section: 01-B 1 1 17 -05 -CH
d. pay for seventy (70%) percent of the Phase 11 design engineering costs and bill the
COUNTY for thirty (30%) percent of said costs in two (2) installments: the first
Installment, $24,000.00, thirty days after COUNTY concurrence to the design
engineering contract, and the remaining balance, following State of Illinois approval of
completed plans.
2. The COUNTY shall:
a. review the Phase 11 design engineering contract for adequacy and acknowledge Its concurrence
for same to the VILLAGE;
b. review and approve final plans in a timely manner; and,
c. pay thirty (30%) percent of the costs of Phase II design engineering (estimated $58,000.00)
In two (2) installments according to 1.d. hereinbefore.
3. The COUNTY and the VILLAGE further agree that their respective successors and assigns shall
be bound by the terms of this Agreement.
