HomeMy WebLinkAboutRESOLUTION - 20-99 - 9/14/1999 - COOK COUNTY BOARD OF APPEALSResolution No. 20-99 A RESOLUTION DIRECTED TO THE COOK COUNTY BOARD OF COMMISSIONERS, COOK COUNTY BOARD OF APPEALS, AND THE COOK COUNTY CLERK FOR TRANSMITTAL TO COOK COUNTY BOARD OF COMMISSIONERS CONCERNING THE PUBLIC HEARING HELD BY THE COOK COUNTY ZONING BOARD OF APPEALS (DOCKET #6888) ON SEPTEMBER 20, 1999 REGARDING THE REZONING OF PROPERTY ON THE NORTH SIDE OF DEVON AVENUE APPROXIMATELY 900 FEET EAST OF RIDGE AVENUE WHEREAS, the applicant, A. Tabangay, Attorney, and owner, E. & L. Baer, of the property legally described as follows: Lot 22 (except the north 210 feet thereof) in William Lumpp's Devon Avenue Farms, being a Subdivision of the south � of Section 33, Township 41 North, Range 11, East of the Third Principal Meridian, as per Plat thereof Recorded as Document 13364273, in Cook County, Illinois. has petitioned for a map amendment to rezone from R-4 Single Family Residence District to I-4 Motor Freight Terminal District; and, WHEREAS, said case has been docketed as Docket Number 6888 by the Cook County Zoning Board of Appeals; and WHEREAS, the Village of Elk Grove is contiguous to this property on the north and west sides. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Village of Elk Grove Village does hereby register objection to the petitioner's request for rezoning of the Subject Property described above for the following reasons: a. The I-4 zoning of the subject property amounts to spot zoning. The land uses to the north are residential (R-3, Single -Family Residence, Elk Grove Village), to the west light commercial (B-2, General Business District, Elk Grove Village), to the east is an unincorporated Cook County light business use (small TV repair and video store). An intensive I-4 zoning classification is inappropriate between these residential and light business land uses. b. The proposed I-4 zoning classification is incompatible with land uses surrounding the Subject Property. Such a use directly adjacent to the Village's single-family residential zoning district is unsuitable and will result in a deleterious impact upon the existing single family residences. Further, the development of an intensive truck/freight terminal will have a detrimental impact upon all surrounding properties. c. The specific use identified by the applicant is a permitted use only within the Village's industrial zoned districts. The Village does not permit these uses west of Tonne Road as would be the case with the Subject Property. d. The Village of Elk Grove Comprehensive Land Use Map, dated April 24, 1990 and adopted by Ordinance No. 2100, (attached hereto as Exhibit "A") identifies the Subject Property as future R-3, Single -Family Residence District. The proposed Cook County I-4 use is far more intense than that planned by the Village of Elk Grove Village for this area; e. The parcel of property is outside the corporate limits of Elk Grove Village and, therefore, will not receive sanitary sewer or water service from the Village of Elk Grove. In an improved urban area, development should be contingent upon the provision of public sanitary sewer and water facilities. f. Elk Grove Village will provide initial emergency Fire and Paramedic services in this area. The increased intensity of personnel and truck traffic that will be created by the proposed rezoning will unfairly place additional emergency service burdens upon the Village. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. 2 Section 3: That the Village Clerk's Office is hereby directed to submit the foregoing Resolution to all governmental bodies that have jurisdiction and/or interest in the development of the premises as set forth above and set forth in the caption thereto.
