HomeMy WebLinkAboutRESOLUTION - 50-98 - 11/17/1998 - GRANT AGMT IL DEPT OF TRANSPORTATIONRESOLUTION NO. 50-98 A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE CLERK TO EXECUTE A GRANT AGREEMENT BETWEEN THE STATE OF ILLINOIS DEPARTMENT OF TRANSPORTATION AND THE VILLAGE OF ELK GROVE VILLAGE (GRANT FOR ROADWAY ENHANCEMENTS) NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Village President be and is hereby authorized to sign the attached documents marked: AGREEMENT a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. Smith Village Clerk Reso602I.D.O.Tgrant.doc Elk Grove/Various Section: 98 -00039 -00 -SA Cook County THIS GRANT AGREEMENT is entered into this 17thday of November, 1998 A.D. by and between the STATE OF ILLINOIS, acting by and through its DEPARTMENT OF TRANSPORTATION, hereinafter called the STATE, and the VILLAGE OF ELK GROVE, in the County of Cook in the State of Illinois, hereinafter called the VILLAGE. WHEREAS, the parties hereto, in the interest of safety and efficient movement of vehicular and pedestrian traffic are desirous of roadway enhancements project in the VILLAGE, said improvement to be identified as Section 98 -00039 -00 -SA and STATE Job No. C-91-290-98, and hereinafter referred to as the PROJECT; and WHEREAS, the 90th General Assembly appropriated $50,000. for FY 1999 from the General Revenue Fund for a Grant to the Village of Elk Grove for roadway enhancements; and WHEREAS, the parties hereto are desirous of said PROJECT in that same will be of immediate benefit to the residents of the area and permanent in nature; and WHEREAS, the STATE and VILLAGE wish to avail themselves of General Revenue Funds appropriated by Public Act 90-585, House Bill 455, Article 86, Section 29 to the Department of Transportation for this PROJECT; NOW THEREFORE, in consideration of the mutual covenants contained herein the parties hereto agree as follows: 1. To make a Grant in the amount of $50,000 payable upon execution of this Grant Agreement by both parties. 2. To pay the grant from the General Revenue Funds appropriated by House Bill 455, Article 86, Section 29. Elk Grove/Various Section: 98 -00039 -00 -SA Cook County MONWOMMIN To prepare or cause to be prepared, the plans, specifications and contract documents; advertise for, receive bids and award the contract for the construction of the PROJECT, in accordance with methods prescribed by the STATE, and cause project to be built following MFT procedures as found in the Manual of Administrative Policies of the Bureau of Local Roads and Streets in accordance with the plans, specifications and contract as approved by the STATE. 2. To certify to the STATE that all necessary right-of-way for the PROJECT has been obtained (if right-of-way is required) or that no additional right-of-way is required. To exercise its franchise rights to cause private utilities to be relocated at no expense to the STATE. 4. To maintain for a minimum of 3 years after the completion of the contract, adequate books, records, and supporting documents to verify the amounts, recipients, and uses of all disbursements of funds passing in conjunction with the contract shall be available for review and audit by the Auditor General; and the VILLAGE agrees to cooperate fully with any audit conducted by the Auditor General and to provide full access to all relevant materials. Failure to maintain the books, records, and supporting documents required by this section shall establish a presumption in favor of the STATE for the recovery of any funds paid by the STATE under the contract for which adequate books, records, and supporting documentation are not available to support their purported disbursement. To submit a final report of expenditures to the STATE prior to the 2 year expiration date indicated herein. U 1. The disposition of encroachments, if any, shall be cooperatively determined by representatives of the VILLAGE and the STATE. 2. The VILLAGE will be responsible for the maintenance of the roadway enhancements. Elk Grove/Various Section: 98 -00039 -00 -SA Cook County 3. No liability shall be incurred by the STATE in excess of the amount of the Grant. Any funds required to complete the PROJECT in excess of the $50,000. will be the responsibility of the VILLAGE. 4. Any unexpended grant funds remaining after completion of the project shall be returned to the Department within forty-five days after final acceptance by the STATE. 5. This Grant agreement shall be binding upon and inure to the benefits of the parties, their successors and assigns. 6. Obligations of the STATE shall cease immediately without penalty or further payment being required if, in any fiscal year, the Illinois General Assembly or applicable Federal funding source fails to appropriate or otherwise make available funds for the work contemplated herein. This Grant is subject to the Illinois Grant Funds Recovery Act, 30 ILCS Act 705. This Grant is valid for two years from the date of execution of the Grant Agreement by the STATE and grant funds are available to the VILLAGE and may be expended by the VILLAGE until said date. Any grant funds which are not expended or legally obligated by the VILLAGE at the end of the Grant Agreement or by the expiration of the period of time grant funds are available for expenditure or obligation, whichever is earlier, shall be returned to the Department within forty-five days. 3 Elk GroveNarious Section: 98 -00039 -00 -SA Cook County IN WITNESS WHEREOF, the parties have caused this agreement to be executed in quintuplicate counterparts,.each of which shall be considered as an original, by their duty authorized officers as of the dates below indicated.
