A RESOLUTION DIRECTED TO THE COOK COUNTY BOARD OF COMMISSIONERS,
COOK COUNTY BOARD OF APPEALS, AND THE COUNTY CLERK FOR TRANSMITTAL
TO COOK COUNTY BOARD OF COMMISSIONERS IN RESPONSE TO THE PUBLIC
HEARING HELD BY THE COOK COUNTY BOARD OF APPEALS ON APRIL 26, 1996
REGARDING THE REZONING OF PROPERTY LOCATED ON THE SOUTH SIDE OF
HIGGINS ROAD APPROXIMATELY 153.7 FEET WEST OF STANLEY AVENUE
WHEREAS, the applicant and owner, T. & B. Pecora, of the
property legally described as follows:
Part of the West 1/2 of the Southwest 1/4 of Section 22,
Township 41 North, Range 11 with a point of beginning
36.82 feet south of the intersection of the West line of
said Southwest 1/4 w/centerline, by deed, of Higgins
Road, thence southeasterly 232.12 feet, thence south
913.05 feet, thence west 230 feet, thence north 947.64
feet to the point of beginning, East of the Third
Principal Meridian (the "Subject Property").
has petitioned for a map amendment to rezone from R-5 Single Family
Residential District to C-6 Automotive Service District with a Special
use in the C-6 Automotive Service District for a storage warehouse; and
WHEREAS, said case has been docketed as Docket Numbers 6392 and
6393 by the Cook County Zoning Board of Appeals; and
WHEREAS, the Village of Elk Grove Village is contiguous to this
property on the North, West and South sides.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, State of Illinois as follows:
Section 1: That the Village of Elk Grove Village does hereby
register objection to the petitioner's request for the rezoning of the
Subject Property described above for the following reasons:
a. The parcel of property is outside the corporate limits
of Elk Grove Village and, therefore, will not receive
sanitary sewer or water service from the Village of Elk
Grove. In an improved urban area, development should be
contingent upon the provision of public sewer and water
facilities.
b. Initial emergency Fire services in this area are
provided by the Village of Elk Grove Village. The
increased intensity of personnel and type of building
construction which will be created by the proposed
rezoning will place additional emergency service burdens
upon the Village..
C. The permitted uses in the C-6 Automotive Service
District are incompatible with the existing Residential
land uses surrounding the property. The requested
rezoning would amount to spot zoning and would be
detrimental to surrounding property.
d. The specific use identified by the applicants, a self
storage warehouse, is a permitted use only within the
Village's industrial district . Such a use directly
adjacent to the Village's single family residential
zoning district is unsuitable and inappropriate.
e. The applicants' comparison of the proposed rezoning to
land uses currently within the Village and south of
their property is inaccurate. Village zoning in this
area provides for Office -Transitional zoning directly
adjacent to Multiple -Family Residential. The petitioner
rezoning request would place an industrial use directly
adjacent to single family residential uses.
f. The Village's Comprehensive Plan dated April 24, 1990
adopted by Ordinance No. 2100 attached hereto as Exhibit
"A" identifies the future zoning of this property, if
annexed to the Village, as R-3 Residential.
Section 2: That this Resolution shall be in full force and
effect from and after its passage and approval according to law.
Section 3: That the Village Clerk's Office is hereby directed
to suhmit the foregoing Resolution to all governmental bodies that have
jurisdiction and/or interest in the development of the premises as set
forth above and set forth in the caption thereto.
