A RESOLUTION ASSURING COMPLIANCE WITH ZONING, GREENSPACE
AND SETBACK REQUIREMENTS OF THE ZONING ORDINANCE REGARDING
ELK CROSSING SHOPPING CENTER
WHEREAS, the Village of Elk Grove Village has acquired tem-
porary and permanent easements as well as a temporary and perma-
nent land acquisition of certain property located with in the Elk
Crossing Shopping Center for the purpose of the Biesterfield Road
Reconfiguration Project; and
WHEREAS, as a result of the above temporary and permanent
taking changes occurred with respect to the initial Site Plan for
said Shopping Center including the relocation of signs , parking
stalls and lighting and an adjustment to the open space and set-
back requirements of the Zoning Ordinance in certain instances ;
and
WHEREAS, after a review by the Village Engineer it was deter-
mined that the Shopping Center would still be in compliance with
the applicable zoning and subdivision requirements of the Village
subsequent to the condemnation and land acquisition by the Village.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook
and DuPage, Illinois as follows :
Section 1: That the Elk Crossing Shopping Center is hereby
determined to be in compliance with applicable Village zoning and
subdivision requirements relating to zoning, greenspace and set-
back requirements subsequent to the condemnation including the
temporary and permanent taking of easements and land for the Bies-
terfield Road Reconfiguration Project. It is further determined
and declared that all representations concerning compliance made
during the course of negotiations with the owner of the Elk Cross-
ing Shopping Center by Village employees and officials including
the Village Engineer and the Village Attorney are hereby ratified
and affirmed and that said Shopping Center will not be deemed a
non-conforming use as same is defined in the Zoning Ordinance of
the Village of Elk Grove Village.
Section 2: That this Resolution shall be in full force and
effect from and after its passage and approval according to law.
