HomeMy WebLinkAboutRESOLUTION - 16-95 - 3/14/1995 - AGRMT/NWMCRESOLUTION NO. 16-95 A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE CLERK TO EXECUTE AN AGREEMENT BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND NORTHWEST MUNICIPAL CONFERENCE (CMAQ BIKE RACK PROGRAM) NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Village President be and is hereby authorized to sign the attached documents marked: MEMORANDUM OF AGREEME14T a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. PASSED this 14th day of March , 1995. Smith Village Clerk MEMORANDUM OF AGREEMENT WHEREAS, the Chicago Area Transportation Study has awarded to the Regional council of Mayors the use of Congestion Mitigation and Air Quality (CMAQ) funds from the federal Intermodal Surface Transportation Efficiency Act (ISTEA) for the purchase and installation of bicycle racks and lockers (Project); and WHEREAS, the CMAQ funds provide 80% of the cost of said Project, requiring a 20% match by the participating local agency members of the Council of Mayors; and WHEREAS, the Village of Buffalo Grove has agreed to act as Lead Agency for the joint agreement required for the implementation of said Project on behalf of all participating agencies in the Northwest Council area; and WHEREAS, the Northwest Municipal Conference has agreed to facilitate the bookkeeping and cash handling. NOW, THEREFORE, the parties hereby agree as follows: As a participant in said Project, the Village/City of Elk Grove Village agrees to pay to the Northwest Municipal Conference an amount equal to its estimated match share of said Project, within 21 days of written notice from the Northwest Municipal Conference. BE IT FURTHER AGREED, that the proceeds of the match shares from the participating agencies will be deposited into an interest bearing account. Interest will not accrue to the participating agencies. BE IT FURTHER AGREED, that if the final contract price is greater than estimated, the Village/City of Elk Grove Vlg, shall pay to the Northwest Municipal Conference its share of such increase within 30 days of notice and similarly, if the final price is less, the Northwest Municipal Conference shall refund to the Village/City of Elk Grove Village its share of such decrease within 30 days. BE IT FURTHER AGREED, that the Northwest Municipal Conference will remit the total match share from all participating agencies to the Village of Buffalo Grove. BE IT FURTHER AGREED, that the Village/City of Elk Grove Village, will make available a staff member to act as liaison with the successful contractor for the purpose of setting locations and providing general supervision and inspection.
