HomeMy WebLinkAboutRESOLUTION - 31-95 - 5/9/1995 - AGRMT/IDOTRESOLUTION NO. 31-95 A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE CLERK TO EXECUTE AN AGREEMENT BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND ILLINOIS DEPARTMENT OF TRANSPORTATION (ARLINGTON HEIGHTS ROAD IMPROVEMENTS) NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Village President be and is hereby authorized to sign the attached documents marked: Agreement (Illinois Department of Transportation) a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. D. 19-9,5, by and between the STATE OF ILLINOIS, acting by and through its DEPARTMENT OF TRANSPORTATION, hereinafter called the STATE, and the Village of Elk Grove, County of Cook, of the State of Illinois, hereinafter called the VILLAGE. The VILLAGE'S cost shall be determined by multiplying the final quantities times contract unit prices plus 15% for construction and preliminary engineering. VILLAGE participation toward traffic signals, interconnect, and utility adjustments shall not exceed $18,060 which represents 125% of the estimated construction and engineering costs for the aforedescribed signals and utility adjustments. Village will be granted a waiver of their costs associated with the Traffic Signal installation at Northwest Point Road because of their cost participation for the temporary signals. *Private Benefit Signal - First Chicago Bank NORTHWEST POINT INTERSECTION Widening to provide 3-3.3 meter (11 foot) through traffic lanes in each direction, a southbound left turn lanes, and a northbound right turn lane; BENNETT ROAD INTERSECTION Widening to provide 3-3.3 meter (11 foot) through traffic lanes in each direction, a 3.3 meter (11 foot) and a 3.6 meter (12 foot) left turn lane on Arlington Heights Road, a 5.02 meter (16.5 feet) lane in one direction and a 4.5 meter (15 foot) lane in the other direction as shown on the plans; ILLINOIS ROUTE 72 INTERSECTION Widening and resurfacing approximately 722.3 meters (2370 lineal feet) of Illinois Route 72 (Higgins Road) from 368.8 meters (1210 lineal feet) west of Arlington Heights Road to 15.2 meters (50 lineal feet) east of Ridgewood Road, providing 3-3.3 meter (11 foot) through traffic lanes in each direction, a 5.0 meter (16 foot) median with 5.0 meter (16 foot) and variable width left and right turn lanes as shown on the plans, constructing curb and gutter, new 5' PCC sidewalks and a storm sewer system for highway drainage, and by performing all other work necessary to complete the improvement in accordance with the approved plans and specifications; and WHEREAS, the VILLAGE is desirous of said improvement in that same will be of immediate benefit to the VILLAGE residents and permanent in nature; NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: 1. The STATE agrees to make the surveys, obtain all necessary rights of way, prepare plans and specifications, receive bids and award the contract, furnish engineering inspection during construction, and cause the improvement to be built in accordance with the plans, specifications, and contract. -3- 2. The STATE agrees to pay, or provide for the payment of, all right of way, construction and engineering costs subject to reimbursement by the VILLAGE as hereinafter stipulated. 3. It is mutually agreed by and between the parties hereto that the estimated cost of the improvement and cost proration is as shown on Page 2A. 4. The VILLAGE has passed a resolution appropriating sufficient funds to pay its share of the cost of this improvement, a copy of which is attached hereto as Exhibit A and made a part hereof. Upon award of the contract for this improvement, the VILLAGE will pay to the Department of Transportation of the State of Illinois in a lump sum, from any funds allotted to the VILLAGE, an amount equal to 958 of its obligation incurred under this Agreement, and will pay to said Department the remainder of its obligation (including any nonparticipating costs for FA projects) in a lump sum upon completion of the project, based upon final costs. The VILLAGE agrees to pass a supplemental resolution to provide necessary funds for its share of the cost of this improvement if the amount appropriated herein proves to be insufficient to cover said cost. 5. The VILLAGE has adopted, and will put into effect, prior to the STATE advertising for the work to be performed hereunder, an ordinance requiring that parking be prohibited along Arlington Heights Road, and along Illinois Rotue 72 (Higgins Road, within the limits of this improvement, within the VILLAGE limits, a copy of which is attached hereto as Exhibit B and made a part hereof, and will, in the future, prohibit parking at such locations within, or immediately adjacent to, this improvement, as may be determined by the STATE or be necessary from traffic capacity studies. -4- 6. The VILLAGE has adopted, and will put into effect, prior to the STATE advertising for the work to be performed hereunder, an appropriate ordinance prohibiting the discharge of sanitary sewage and industrial waste water into any storm sewers or drainage facilities constructed as part of this improvement, a copy of which is attached hereto as Exhibit C and made a part hereof. 7. Prior to the STATE advertising for the work to be performed hereunder, the disposition of encroachments will be cooperatively determined by representatives from the VILLAGE and the STATE. The VILLAGE has adopted, and will put into effect, prior to the STATE advertising for the work to be performed hereunder, an appropriate ordinance relative to the disposition of encroachments and prohibiting in the future any new encroachments within the limits of the improvement, a copy of which is attached as Exhibit D and made a part hereof. 8. The VILLAGE agrees to adopt a resolution or send a letter, prior to the STATE advertising for the work to be performed hereunder, approving the plans and specifications as prepared. 9. The VILLAGE agrees not to permit driveway entrance openings to be made in the curb as constructed, without the consent of the STATE. 10. The STATE shall cause private utilities to be relocated at no expense to the STATE or VILLAGE. Where a municipal utility has been installed 1. on right of way acquired by the STATE or 2. within defined limits of a route the STATE has accepted for maintenance responsibilities subsequent to the date of such acceptance, the municipality will bear all utility relocation or adjustment costs made necessary by the construction of this improvement. -5- 11. Upon completion of the improvement and final field inspection by the STATE, and so long as Arlington Heights Road and Illinois Route 72 are used as STATE highways, the STATE agrees to maintain, or cause to be maintained, the median, the through traffic lanes, the left turn and right turn lanes, and the curb and gutter or stabilized shoulders and ditches adjacent to those lanes. The STATE will be responsible for the maintenance of lane line and median line markings. 12. Upon final field inspection of the improvement, the VILLAGE agrees to maintain, or cause to be maintained, those portions of the improvement which are not maintained by the STATE, including sidewalks, parkways, guardrails, crosswalk, stopline marking, and maintenance of the mast arm cross street signing facing VILLAGE maintained streets, VILLAGE owned utilities, including all highway appurtenances thereto, highway lighting, including furnishing the electrical energy therefore, and shall maintain the storm sewers and appurtenances by: Performing those functions necessary to keep the sewer in a serviceable condition, including cleaning sewer lines, inlets, manholes, and catch basins along with the repair or replacement of inlet, manhole and catch basins' frames, grates or lids, plus structural failures to a maximum length of 12 feet between adjacent manholes. It is further agreed that the signals shall be maintained to the Level of Maintenance shown above. It is understood that Level of Maintenance II exceeds the manual requirements and is prescribed for those signals that the District Engineer, with the concurrence of the Engineer of Operations, determines to require a higher level of service for adequate operations of the highway system at those locations. -7- The parties hereto agree that the traffic signal maintenance and energy provisions of this Agreement shall remain in effect for a period of twenty (20) years from the date of its execution, or so long as the traffic signals covered by the terms of this Agreement or any amendment hereto, remain in place, either in their current or some modified configuration, whichever is the shorter period of time. Such an effective term shall apply unless otherwise agreed in writing by the parties hereto. The STATE agrees to make arrangements with the local power company to furnish the electrical energy for the operation of the traffic signals. The VILLAGE agrees to pay its proportionate share of this cost as billed by the local power company. The STATE retains the right to control the sequence and timing of the traffic signals. 13b It is also understood that STATE will maintain the "closed loop" interconnection system from Central Road to Illinois Route 72. Maintenance costs for "closed loop" interconnection system will be proportioned as follows: State 85.58 Elk Grove 28 Others 12.58 -8- THIS AGREEMENT, and the covenants contained herein, shall become null and void in the event the contract covering the construction work contemplated herein is not awarded within 3 years subsequent to execution of this Agreement.
