HomeMy WebLinkAboutRESOLUTION - 36-95 - 5/23/1995 - SENATE BILL 92RESOLUTION N0. 36-95 A RESOLUTION IN OPPOSITION TO AMENDMENTS TO SENATE BILL 92 WHEREAS, an amendment to Senate Bill 92 has been proposed which would provide in part that "access to information shall not be denied, however, merely because the applicant is a commercial enterprise"; and WHEREAS, in 1994, it was agreed by various interested parties, including the Illinois Municipal League, Municipal Clerks of Illinois, the Illinois Press Association, and many Councils of Government throughout Illinois, that a two-year moratorium would be placed on consideration of amendments to the Freedom of Information Act and the Open Meetings Act; and WHEREAS, this particular amendment will allow commercial enterprises to employ the Freedom of Information Act to request information solely for the purpose of pecuniary gain or profit; and WHEREAS, listings of business and/or residents could be used for the purpose of solicitation by commercial enterprises; and WHEREAS, the Freedom of Information Act presently states that it is not intended for the purpose of "furthering a commercial enterprise," and the passage of this amendment would directly conflict with this intent; and WHEREAS, providing such listings to any and all commercial enterprises requesting them would be burdensome and would not further the general purposes of the Act, but could, in fact, allow for unwarranted invasions of privacy. NOW, THEREFORE BE IT RESOLVED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, State of Illinois as follows: Section 1. That the President and Board of Trustees of the Village of Elk Grove Village express their opposition to this amendment to Senate Bill 92. Section 2. That the President and Board of Trustees of the Village of Elk Grove Village urge the Illinois General Assembly to give serious consideration and vote in concurrence with their position in opposition of this legislation. Section 3. That this Resolution be conveyed to Governor Jim Edgar, Senator Peter G. Fitzgerald, Senator James Philip, Representative Terry R. Parke and Representative Kathleen L. Wojcik. Section 4. That this Resolution shall be in full force and effect from and after its passage and approval as provided by law. VOTE: AYES: 5 NAYS: 0 ABSENT: 1 PASSED this 23rd day of May , 1995.
