A RESOLUTION APPROVING A STATEMENT OF COMMITMENT TO
INSTALL PUBLIC SIDEWALKS BETWEEN THE VILLAGE OF ELK
GROVE VILLAGE AND ELK GROVE VILLAGE INDUSTRIAL PARK, LTD.
(900-950 Thorndale Road)
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State of
Illinois:
Section 1: That the Village of Elk Grove Village does hereby accept
the attached document marked:
"Statement of Commitment to Install Public Sidewalks"
a copy of which is attached hereto and made a part hereof as if fully set
forth.
Section 2: That this Resolution shall be in full force and effect
from and after its passage and approval according to law.

STATEMENT OF COMMITMENT
TO CONSTRUCT PUBLIC SIDEWALK
Legal Description of Property:
Lot 37 in Elk Grove Industrial Park Unit 16, being a subdivision in the West 1/2 of
Section 3, Township 40 North, Range 11, East of the Third Principal Meridian, according
to the Plat thereof recorded May 11, 1977 as Document No. $77-34937, (except that part
of said Lot 37 described as follows; beginning at the Northwest corner of said Lot 37'
thence South 89 degrees 16 minutes 32 seconds East along the North line of said Lot 37,
244.33 feet to the most northerly Northeast comer of said Lot 37; thence South 02
degrees I 1 minutes 33 seconds West along the East line of said Lot 37, 33.46 feet to a
point of curvature in said East line; thence Southeasterly along the Northeasterly line of
said Lot 37, being a curved line convex Southwesterly, having a radius of 382.92 feet and
being tangent to said last described line at said last described point, an are distance of
44.87 feet (the chord of said arc bears South 01 degrees 09 minutes 53 seconds East,
44.85 feet); thence North 87 degrees 48 minutes27 seconds West, 10.00 feet; thence
South 02 degrees 11 minutes 33 seconds West, 195.18 feet; thence North 87 degrees 48
minutes 27 seconds West, 226.62 feet to a point on the West line of said Lot 37, 267.40
feet, as measured along said West line, South of the Northwest corner of said Lot 37;
thence North 00 degrees 00 minutes 22 seconds West along the West line of said Lot 37,
267.40 feet to the place of beginning), in DuPage County, Illinois.
ELK GROVE VILLAGE INDUSTRIAL PARK LTD. agrees to construct public
sidewalk along the Thomdale frontage of the above-described property in the Village of
Elk Grove Village immediately upon receiving notice to do so from the Village of Elk
Grove Village. We agree to construct all storm sewers and appurtenances required for the
public sidewalk construction and will secure all the necessary permits for the
construction.
Should the Village of Elk Grove Village award a contract for the sidewalk and/or storm
sewer construction, we agree to pay our pro -rata share of the cost.
If the property ownership is to be transferred prior to the construction of a public
sidewalk and/or storm sewer, we agree to require the new owner to execute a "Statement
HAMILTON PARTNERS, INC.
of Commitment to Install Public Sidewalk" satisfactory to the Village of Elk Grove
Village prior to the transfer of ownership.
I understand that the sidewalk construction waiver and the "Statement of Commitment to
Construct Public Sidewalk" will be recorded in the County Clerk's office by the Village
of Elk Grove Village and the cost thereof is the responsibility of the applicant.
