(300 BUSSE ROAD) NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois: Section 1 : That the Village of Elk Grove Village does hereby accept the attached document marked: "Statement of Commitment to Construct Public Sidewalk" a copy of which is attached hereto and made a part hereof as if fully set forth. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 12th day Of December , 1995. An Ohio Limited Liability Corporation 1765 Merriman Road Akron, Oltio 44313 216-836-9971 216-864-8094 STATEMENT OF COMMITMENT TO CONSTRUCT PUBLIC SIDEWALK LEGAL DESCRIPTION OF SUBJECT PROPERTY: Lots 2 and 3 in Sixpence Inn subdivision Unit 2, being a re-subdivision of Lot 162 in Higgins Industrial Park Unit 112 and Lots I and 2 in Sixpence Inn subdivision, being a re-subdivision of Lot 161 in said Higgins Industrial Park Unit 112, being a subdivision in the Northeast 1/4 of Section 27, township 41 North, Range 11, East of the third principal meridian, in Cook County, Illinois. OMEG Associates, Ltd., an Ohio Limited Liability Corporation, agrees to construct public sidewalk along the Busse Road and Oakton Street frontages of the above-described property in the Village of Elk Grove Village immediately upon receiving notice to do so from the Village of Elk Grove Village. We agree to construct all storm sewers and appurtenances required for the public sidewalk construction and will secure all the necessary permits for the construction. Should the Village of Elk Grove Village award a contract for the sidewalk and/or storm sewer construction, we agree to pay our pro-rata share of the costs. If property ownership is to be transferred prior to the construction of a public sidewalk and/or storm sewer, we agree to require the new owner to execute a "Statement of Commitment to Install Public Sidewalk" satisfactory to the Village of Elk Grove Village prior to the transfer of ownership. I understand that the sidewalk construction waiver and the "Statement of Commitment to Construct Public Sidewalk" will be recorded in the County Clerk's office by the Village of Elk Grove Village and the cost thereof is the responsibility of the applicant.
