HomeMy WebLinkAboutRESOLUTION - 26-94 - 5/10/1994 - 2940 OLD HIGGINS RDRESOLUTION NO. 26-94 A RESOLUTION DIRECTED TO THE CITY OF CHICAGO, ZONING BOARD OF APPEALS IN RESPONSE TO A PUBLIC HEARING TO BE HELD ON MAY 20, 1994 REGARDING THE APPLICATION FOR SPECIAL USE PERMIT TO CONSTRUCT A REPROCESSABLE CONSTRUCTION/DEMOLITION MATERIAL FACILITY AT 2940 OLD HIGGINS ROAD (as known as 11600 W. TOUHY) WHEREAS, the site owner, Raymond E. Plote and Daniel R. Plote have an application pending before the City of Chicago, Zoning Board of Appeals for a Special Use Permit to construct and operate a reprocessable construction/demolition Material Facility in an M3.2 Manufacturing District; and WHEREAS, said case has been documented as Calendar #140-94-S by the Zoning Board of Appeals; and WHEREAS, the Corporate boundaries of the Village of Elk Grove Village are contiguous to this property on the west side; and WHEREAS, the property is contiguous to residential dwelling units to the north and south and to office/warehouse space in Elk Grove Village to the west; NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Village of Elk Grove Village does hereby register objection to the petitioner's application for Special Use Permit for the following reasons: a. The operation of a reprocessable construction/demolition facility will be detrimental to the public welfare and injurious to the other property or improvements in the area surrounding the property by causing the following: excessive construction noise which will travel beyond the property lines; excessive diesel fuel odors from idling semi -trucks; excessive traffic delays by stacking trucks onto Old Higgins Road; excessive dust resulting from the operation of the facility; and excessive mud on densely travelled State roadways. b. The facility will not be served by a municipal water, sanitary, or storm sewer system. In an improved urban area, with neighboring residential uses, the development should have public sewer and water systems; C. The use requested by the application would not be permitted in the zoning classification of the Village of Elk Grove Village which borders the property; d. That an updated opinion be obtained from the North Cook County Soil and Water Conservation District regarding the proposed use on the site as required by law as the last opinion is stale having been rendered in 1986; e. That an opinion be obtained from the State of Illinois Department of Conservation as to the nature of any threatened or endangered species on the property; and f. Initial Fire and Paramedic response is provided by the City of Chicago,which Fire Station is considerable distance from the property in the event of an emergency, resulting in an increased danger for personnel on the site. Section 2: That this Resolution be in full force and effect from and after its passage and approval according to law. Section 3: That the Village Clerk's Office is hereby directed to submit the forgoing Resolution to Joseph J. Spingola, Chairman, Zoning Board of Appeals, and to the Clerk of the Zoning Board of Appeals of the City of Chicago. PASSED this 10th day of APPROVED this 10th day of ATTEST: Patricia S.
