(1601 PRATT BOULEVARD) NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois: Section 1 : That the Village of Elk Grove Village does hereby accept the attached document marked: "Statement of Commitment to Construct Public Sidewalk" a copy of which is attached hereto and made a part hereof as if fully set forth. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT 0 PASSED this 13th day of December , 1994. Smith Village Clerk KLENK & A1EIER ENTERPRISES, INC. 901 Wilshire Drive, Suite 400 Troy, A41 48084 (810) 362-3600 STATEMENT OF COMMITMENT TO CONSTRUCT PUBLIC SIDEWALK LEGAL DESCRIPTION OF SUBJECT PROPERTY: Lot 1 (except the North 15 feet thereof) in Centex Industrial Park Unit 20, being a subdivision in Section 34, Township 41 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois--also--Lot 2 (except the North 15 feet thereof) in Centex Industrial Park Unit 21, being a subdivision of Section 34, Township 41 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois. Klenk & Meier Enterprises agrees to begin construction of public sidewalk along the East frontage of the above-described property in the Village of Elk Grove Village immediately upon receiving notice to do so from the Village of Elk Grove Village and will complete such construction within a reasonable period of time. The Village of Elk Grove Village agrees that notice to construct will not be given unless adjoining property owners are also required to construct connecting sidewalks or the Village has a reason to require construction which is equal in validity to requiring other owners to construct. We agree to construct all storm sewers and appurtenances required for the public sidewalk construction and will secure all the necessary permits for the construction. Should the Village of Elk Grove Village award a contract for the sidewalk, and/or storm sewer construction, we agree to pay our pro-rata share of the cost. If property ownership is to be transferred prior to the construction of a public sidewalk, and/or storm sewer, we agree to require the new owner to execute a "Statement of Commitment to Install Public Sidewalk" satisfactory to the village of Elk Grove Village prior to the transfer of ownership. I understand that the sidewalk construction waiver and the "Statement of Commitment to Construct Public Sidewalk" will be recorded in the County Clerk's office by the Village of Elk Grove Village and the cost thereof is the responsibility of the applicant.
