HomeMy WebLinkAboutRESOLUTION - 71-94 - 12/13/1994 - PLAT OF SUB/RIEMER'S FIRST RESUB RESOLUTION NO. 71-94 A RESOLUTION APPROVING A PLAT OF SUBDIVISION ENTITLED RIEMER'S FIRST RESUBDIVISION NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows : Section 1: That approval is hereby given to the Final Plat of Riemer' s First Resubdivision for property located in Section 26, Township 41 North, Range 11, East of the Third Principal Meri- dian, in Cook County, Illinois, a copy of which is attached here- to and made a part hereof as if fully set forth. Section 2: That Resolution No. 79-68 previously passed and approved by the Village on August 27 , 1968 is hereby rescinded. Section 3: That the Subdivision approval is contingent upon compliance with the Non-Exclusive Easement for Egress and Ingress for the subject property a copy of said Easement being on file in the Office of the Village Clerk. Section 4: That the Village in approving the Plat of Subdi- vision does waive subdivision requirements with respect to the re- quirement for public street frontage of each lot of said Subdivi- sion and does hereby waive the requirement concerning water and sanitary sewer service thereby permitting such service to be pro- vided by a private water and sanitary sewer line. Section 5: That this Resolution shall be in full force and effect from and after its passage and approval according to law. VOTE: AYES: 6 NAYS: 0 ABSENT: 0 PASSED this 13th day of December 1994. Smith VILLAGE CLERK -2- NON-EXCLUSIVE EASEMENT FOR EGRESS AND INGRESS The Northern Trust Bank of Illinois, not personally, but as Successor Trustee to O'Hare International Bank, N.A., under Trust Agreement dated October 16, 1964, and known as Trust No. 77, of 50 South LaSalle Street, Chicago, Illinois 60675 (hereinafter referred to as "Declarant") is the Owner of Parcels One and Two, legally described in "Exhibit One", attached hereto -2,u inade part hereof. Declarant desires to create for.the benefit of Parcel Two an easement for ingress and egress over a portion of Parcel One, said easement legally described in "Exhibit Two", attached hereto and made part hereof, under the terms and conditions hereinafter stated. NOW, THEREFORE, Declarant hereby declares and establishes a perpetual non-exclusive easement over Parcel One, as legally described in Exhibit Two, for the benefit of Parcel Two. This easement is non-exclusive and is in addition to that certain Easement for Ingress and Egress heretofore granted to the owners of the property east and adjacent to Parcel Two, as stated in document dated September 30, 1965 and recorded in the Office of the Cook County Recorder of Deeds, Cook County, Illinois, as Document No. 19618163. The successors and assigns to the ownership of Parcel Two shall be obliged to share in the installation, maintenance and repair of any and all improvements made to the easement to facilitate ingress and egress from time to time on a basis proportionate to the interests of all adjoining land owners having legal benefit of the improvements (based upon the total acreage of the land owned by each land owner having legal benefit of the improvements compared to the total acreage of all land owned by all landowners having legal benefit of the improvements), 1 which shall include but not necessarily be limited to Declarant, its successors and assigns, as well as the legal owners from time to time of the land east and adjacent to Parcel Two which have the benefit of the easement heretofore referenced and recorded as Document No. 19618163. This easement shall inure to the benefit of and be binding upon Declarant and its successors, assigns, grantees, devisees, heirs and beneficiaries, and shall be a covenant which shall run with the land.
