HomeMy WebLinkAboutRESOLUTION - 14-92 - 2/25/1992 - AGRMT/IL DEPT OF REVENUERESOLUTION NO. 14-92 A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE CLERK TO EXECUTE A RECIPROCAL AGREEMENT ON EXCHANGE OF INFORMATION BETWEEN THE VILLAGE OF ELK GROVE, ILLINOIS AND THE ILLINOIS DEPARTMENT OF REVENUE AND AUTHORIZING THE VILLAGE PRESIDENT AND DIRECTOR OF FINANCE TO EXECUTE THE MINIMUM STANDARDS REQUIRED TO SAFEGUARD INFORMATION GIVEN AS A RESULT OF A RECIPROCAL AGREEMENT ON THE EXCHANGE OF INFORMATION. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Village President and Village Clerk be and are hereby authorized to sign the attached documents marked: RECIPROCAL AGREEMENT ON EXCHANGE OF INFORMATION BETWEEN THE VILLAGE OF ELK GROVE, ILLINOIS AND THE ILLINOIS DEPARTMENT OF REVENUE a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. Section 2: That the Village President and Director of Finance be and are hereby authorized to sign the attached documents marked: MINIMUM STANDARDS REQUIRED TO SAFEGUARD INFORMATION GIVEN AS A RESULT OF A RECIPROCAL AGREEMENT ON THE EXCHANGE OF INFORMATION a copy of which is attached hereto and made a part hereof as if fully set forth. Zettek Village President RECIPROCAL AGREEMENT ON EXCHANGE OF INFORMATION BETWEEN THE VILAGE OF ELK GROVE, ILLINOIS AND THE ILLINOIS DEPARTMENT OF REVENUE The Illinois Department of Revenue in accordance with the statutes of the State of Illinois, agrees to share with the Village of Elk Grove State tax returns and return information for the Illinois Retailers Occupation Tax, Services Occupation tax, Use Tax, and Service Use Tax. Conversely, the Village of Elk Grove agrees to share with the Illinois Department of Revenue sales tax returns and return information, for the taxes which it imposes, by ordinance and administers. It is further agreed that all returns and return information exchanged will be used only for the enforcement of State tax statutes and the home rule ordinance and shall be kept confidential in accordance with Illinois statutes. Each party agrees to take appropriate steps to protect from unauthorized disclosure the tax information obtained pursuant to this agreement and to destroy it by shredding. The Department of Revenue shall treat such information as confidential "Non -Record " document in accordance with the shred procedures issued in February, 1987. A copy of this procedure will be made available to the Village of Elk Grove upon their request. The Vi lace of Elk Grove shall sign a separate agreement outlining the minimum standards required by the Illinois Department of Revenue to safeguard information the village will receive pursuant to this agreement. No information will be provided to the village by the Department until such standards have been agreed to by completion of the agreement. The Village of Elk Grove and the Department will provide each other with a list showing the names and official titles of personnel designated by each party to request information, inspect returns or receive related information. Additions to and deletions from the list will be furnished as they occur. In addition, the Department will send a letter to each individual designated to receive information (along with a copy of the minimum safeguard standards) to assure that each of these individuals is aware of their personal responsibility for safeguarding the confidentiality of the information they will be receiving.from the Department. The village may send such information as they feel appropriate to the Department's designees to make them aware of their responsibilites. All requests for information must be in writing and must be signed by one of the individuals designated to receive such information. Tto information will be given over the telephone or pursuant to a telephone request. It is further agreed that either party may refuse to share certain information because of its own administrative reasons. This Agreement may be cancelled by either party at any time and will be cancelled in the event of any unauthorized use or disclosure of State tax returns or return information obtained pursuant to this Agreement or failure to abide by the procedures set forth by the Department for safeguarding th confidentiality of such returns or return information. Smith Village Clerk February 25, 1992 Date MINIMUM STANDARDS REQUIRED TO SAFEGUARD INFORMATION GIVEN AS A RESULT OF A RECIPROCAL AGREEMENT ON THE EXCHANGE OF INFORMATION 1. All requests for information under this agreement will be in writing and addressed to the appropriate Illinois Department of Revenue contact person. 2. Information received under the Reciprocal Agreement on the Exchange of Information will be kept in a locked storage facility, i.e., locked file cabinet, closet, desk, etc., which is only accessible to persons authorized under this agreement to receive information. 3. The Village of Elk Grove will promptly notify the Illinois Department of Revenue when an employee who has been authorized to receive information leaves our agency. 4. Any possible or suspected breach of confidentiality will be reported to the Illinois Department of Revenue immediately. 5. The Proper method for destruction of information will be shredding. 6. jbg Village of Elk Grove agrees to allow the Illinois Department of Revenue to physically view their facilities to insure proper compliance with these standards. The Village of Elk Grove agrees to abide by the aforementioned standards in safeguarding the information they receive pursuant to the Reciprocal Agreement on the Exchange of Information which they have entered into with the Illinois Department of Revenue.
