HomeMy WebLinkAboutRESOLUTION - 33-92 - 5/12/1992 - PARKWAY TREE REMOVAL POLICYRESOLUTION NO. 33-92 A RESOLUTION ADOPTING A PARKWAY TREE REMOVAL POLICY FOR THE VILLAGE OF ELK GROVE VILLAGE NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Village President and Board of Trustees hereby adopt the document entitled: Parkway Tree Roots in Sanitary Sewer Service Lines Tree Removal and Replacement Policy - Procedures, Permit and Related Information - a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. PASSED this 12th day of May 1992. APPROVED this 12th day of May 1992. Smith Village Clerk VILLAGE OF ELIC GROVE VILLAGE ILLINOIS PARKWAY TREE ROOTS IN SANITARY SEWER SERVICE LINES TREE REMOVAL AND REPLACEMENT POLICY - PROCEDURES, PERMIT AND RELATED INFORMATION - In instances where a resident believes that a particular tree, located in the parkway adjacent to his property, is causing continual aggravation and expense due to tree root blockage in the sanitary sewer service line, the resident may request to remove said tree in accordance with the following procedures and permit criteria established by the Village. I. IDENTIFICATION OF THE PROBLEM Once a problem relating to a sanitary sewer service is identified, the resident will contact the Department of Engineering and Community Development. An inspection will be scheduled during the excavation or rodding of the sewer service line to determine if the sewer problem is attributable to parkway tree roots. The resident shall be advised of the Department's findings, which shall be made a part of the permit application. if the problem is not attributable to parkway tree roots but the parkway tree requires removal to facilitate the repair or replacement of the sewer service line, the resident will be solely responsible for the removal and replacement of the parkway tree as well as all parkway restoration. if the problem is attributable to parkway tree roots, the resident will be responsible for the removal of the parkway tree (pursuant to the following procedures and cost sharing arrangements) and repair of the sewer service line only. II. PERMIT APPLICATION A. The resident shall select a contractor of his choice and shall submit a completed permit application to the Department of Engineering and Community Development, 901 Wellington Avenue, Elk Grove Village, Illinois 60007. Attachments to the permit shall include: 1. A Plat of Survey for the property. 2. Three (3) detailed hand -drawn copies (minimum size 8 1/2^ x 1111) of a plan showing existing facilities and proposed work. Existing facilities include sidewalk, curbs, driveways, trees, water service boxes, street lights, etc. 3. Contractor's Certificate of Insurance (requirements are attached). 4. $50,000 License and Permit Bond. B. Upon review and approval of the contractor and permit application (approximately ten (10) working days following submission) the resident will be notified to pick up the permit. The following items must be brought in to complete permit processing. 1. $25 inspection fee. 2. $500 refundable cash bond. The Village must inspect the tree removal and replacement and sanitary sewer service repair. Please call 439-3900 extension 313 for inspection at least twenty-four (24) hours in advance of work. A. if the problem is attributable to tree roots (as outlined in Item I) the Village will perform parkway restoration to include the replacement of a tree in a location found acceptable by the Village Forester, and the placement of topsoil and sod, as necessary. In some cases, replacement of the parkway tree will not be possible due to utility conflicts, spacing of adjacent parkway trees, etc. In this case, the Village will fill the depression and sod the parkway only. B. Parkway restoration will be performed to a reasonable limit only. Excessive damage to the parkway will not be restored by the Village. in addition, any damage to sidewalks, driveways, curbs and gutters, street pavement, fire hydrants or utility poles will be the responsibility of the resident/contractor. C. The resident is responsible for watering of the tree and sod. The resident must follow the established Village watering policy: 1. Weekdays, between the hours of 5:00 P.M. - 9:00 P.M. Saturday and Sunday, all day. V. HOMEOWNER RESPONSIBILITY The homeowner shall be responsible for maintaining the new tree and sod in an acceptable condition. To be acceptable the sod shall be in a live, healthy condition and be knitted to the soil. The guarantee periods for the sod and tree are forty-five (45) days and one year respectively. Should either the sod or tree die within the guarantee period due to the homeowners lack of proper care and/or watering, the homeowner will be responsible for replacement of the sod and/or tree at their own expense. VI. FINAL INSPECTION Upon completion the Department for a final completion of returned.
