HomeMy WebLinkAboutRESOLUTION - 44-92 - 7/14/1992 - PERSONNEL RULES & REGS AMENDEDRESOLUTION NO. 44-92 A RESOLUTION AMENDING THE PERSONNEL RULES AND REGULATIONS RELATING TO OVERTIME COMPENSATION AND HOLIDAY POLICIES NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1. That the President and Board of Trustees do hereby authorize an amendment to Section 7.8 entitled, Overtime Compensation and Section 8.2 entitled, Holidays and Holiday Pay, of the Personnel Rules and Regulations of the Village of Elk Grove Village, a copy of the revision is attached hereto and made a part hereof as if fully set forth. Smith Village Clerk 7.8 Overtime Compensation Overtime is generally assigned to employees currently performing the work needed or who are qualified to perform the required work. All employees are required to work any overtime as needed unless excused by their immediate supervisor. Consideration will be given to employees who with to be excused based upon advance notice and the reason for not being available. Rate of Overtime Compensation Overtime compensation for eligible supervisory and non - supervisory employees will be at a rate of time and one-half for all authorized hours worked beyond the established work period, as designated by the Village in accordance with the Fair Labor Standards Act or as specifically provided for under the terms and conditions of an applicable collective bargaining labor agreement. B. Eliqibility for Full and Part -Time Personnel Unless specifically exempt from overtime compensation as listed in (C) below, employees of the Village who work a thirty-seven and one-half (37.5) hour or a forUy (40) hour work week, will be compensated for overtime as follows: 1. Employees working a thirty-seven and one-half hour (37 1/2) work period (week) will be compensated at a rate of time and one-half for all hours worked in excess of forty (40) hours per week. Hours worked shall include all hours paid with the exception. that sick leave time will not be included in the computation of total hours worked. 2. Employees working a forty (40) hour work period (week) will be compensated at a rate of time and one-half for all hours worked in excess of forty (40) hours per week. Hours worked shall include all hours paid with the exception that sick leave time will not be included in the computation of total hours worked. 3. Overtime compensation for Police Officers who normally work a forty (40) hour work week will be paid in accordance with the applicable provisions of their current labor agreement. Sworn Firefighters, including Firefighter Paramedics, who work a twenty-four (24) hours on and forty-eight (48) hour off shift schedule, averaging fifty six (56) hours work week, are compensated for overtime in accordance with the Section 7 (k) exemption of the Fair Labor Standards Act for hours worked in excess of two hundred twelve (212) hours in a twenty-eight (28) day work cycle, with vacation, holiday, and sick time hours excluded from the hours worked total. C. Supervisory Classifications Exempt from the Overtime on Supervisory, administrative, managerial, confidential and professional employees are generally exempt from the overtime compensation benefit. Classifications which are not eligible for overtime compensation are as follows: Village Manager Assistant Village Manager Police Chief Deputy Police Chief Police Lieutenant Fire Chief Deputy Fire Chief Fire Captain Director of Public Works Street Superintendent Building and Vehicle Maintenance Superintendent Utility Superintendent Director of Finance Assistant Director of Finance Accounting Manager Purchasing Agent Personnel Officer Health Services Coordinator Sanitarian Data Processing Supervisor Community Services Coordinator Village Clerk 3 Deputy Village Clerk Director of Engineering and Community Development Assistant Village Engineer Staff Engineer Social Worker Coordinator Social Worker Health Nurse Administrative Assistant, Manager's Office Administrative Assistant, Public Works Administrative Assistant, Civil Defense Training Coordinator Plan Reviewer Economic Development Assistant Systems Analyst Programmer/P.C. Specialist D. Some su ervisor administrative, mana erial, confidential an professional classifications are a foible for overtime 1. When the needs of the department are such that the first line supervisor must work additional time because of inadequate supervisory manpower; or 2. When emergency situations develop which require their supervision. (Emergency situations for purposes of this item shall be defined by the first line supervisor's Department Head.) For purposes of this section, the following classifications are designated as first line supervisory positions: Payroll/Cash Control Supervisor Records Supervisor Public Works Foreman Vehicle Maintenance Foreman Utility Foreman Police Sergeant Plan Reviewer/Building Inspection Supervisor Fire Lieutenants 8.2 Holidays and Holiday Pay All active permanent full time, permanent part-time and probationary employees shall receive eleven (11) paid holidays during the course of a calendar year. These eleven (11) paid holidays are sub -divided into two (2) holiday groups, fixed and floating. A. For all general personnel the eleven (11) paid holidays are sub -divided into eight (8) fixed holidays and three (3) floating holidays. 1. The eight (8) fixed holidays as established annually by the Village Board are as follows: New Years Day Presidents Day Memorial Day Independence Day Labor Day Thanksgiving Day Friday after Thanksgiving Christmas Day 2. The three (3) Floating Holidays can be taken at the discretion of the employee; however, Departmental approval must be secured prior to the use of the floating holidays. Floating Holidays may be taken in increments of two hours or more. 3. For employees working a standard work week, a scheduled holiday that falls on a Saturday shall be observed the Friday before. A scheduled holiday that falls on a Sunday, shall be observed the following Monday. B. Sworn personnel excluding Police Officers also have eleven (11) paid holidays. These eleven (11) paid holidays are sub -divided into seven (7) fixed holidays and four (4) floating holidays. 1. The seven (7) fixed holidays as established annually by the Village Board are as follows: New Years Day Presidents Day Memorial Day Independence Day Labor Day Thanksgiving Day Christmas Day 2. The four (4) Floating Holidays can be taken at the discretion of the employee; however, Departmental approval must be secured prior to the use of the floating holidays. Floating Holidays may be taken in increments of two hours or more. 3. For employees working a non-standard work week, a scheduled holiday shall be observed on the exact day that the holiday falls. C. Holidays and Holiday Pay for Police Officers shall be as specified in the appropriate article of their current labor agreement. D. Holiday Pay 1. Eligible employees will be compensated at their regular (straight time) rate for each holiday observed. 2. General employees who work a standard work week and who are required to work on a fixed holiday shall be compensated at a rate of time and one-half for hours worked on a holiday in addition to their regular holiday pay. 3. Sworn employees who work a non-standard work week and whose normal schedule requires them to work on an official fixed holiday, shall be compensated for hours worked on a holiday at a straight time rate in addition to receiving regular holiday compensation. 4. Sworn employees who work a non-standard work week and whose normal day off falls on a fixed holiday, will be permitted to schedule an alternative day off in lieu of the fixed holiday which has fallen on their regular day off. The scheduling will be subject to the approval of the Department Head. E. Pro -rating floating holiday eligibility for newly hired permanent full time sworn and non -sworn employees. 1. Newly hired sworn personnel are eligible for four (4) floating holidays during the calendar year if hired in the first quarter January, February, March of the calendar year. If hired in the second quarter of the calendar year, April, May, or June, they are eligible for three (3) floating holidays. If hired in the third quarter of the calendar year, July, August, or September, they are eligible for two (2) floating holidays. If hired in the last quarter of the calendar year, October, November, or December, they are eligible for (1) floating holiday. 2. Newly hired non -sworn personnel are eligible for three (3) floating holidays if hired in the first quarter, January, February, or March, of the calendar year. If hired in the second quarter of the calendar year, April, May, or June, they are eligible for two (2) floating holidays. If hired in the third quarter of the calendar year, July, August, or September, they are eligible for one (1) floating holiday. If hired during the last quarter of the year, October, November, or December, they are not eligible for any Floating Holidays. 3. Employees who terminate their employment with the Village during the calendar year are only entitled to use the number of floating holidays that are accrued as defined above. In no event are employees eligible to receive pay for unused floating holidays. 4. Employees who do not use their entitled floating holidays in the given calendar year will not receive additional compensation or additional time off as a carryover into the next calendar year. F. Holiday Pay Eligibility 1. To be eligible for holiday compensation, employees must work the day before and the day after the holiday. Employees who are absent from work the day before and/or the day after, the holiday shall not be eligible for holiday compensation unless the absence is approved by the Department Head. 2_ When scheduled to work on a paid holiday, if the employee is unable to report to work, he/she shall not be eligible for the holiday compensation unless proof of an excusable absence is submitted and approved by the Department Head. If acceptable proof is submitted and approved by the Department Head, the employee shall be compensated with holiday pay which shall equal one day's pay. Under no circumstances will an employee be compensated with both holiday pay and sick leave pay when the employee is unable to report to work on a scheduled holiday. 3. If a scheduled holiday should fall during a seminar or training exercise, the employee will be allowed to re -schedule the holiday. The seminar or training exercise must be on going during the scheduled holiday and the employee's attendance must be authorized and paid for by the Village. 4. Permanent part-time personnel will be eligible for holidays provided they have completed twelve (12) months of continuous service and average at least 50 percent of a regular work week schedule, for the classification occupied, shall be entitled to holiday benefits on a pro -rata basis.
