HomeMy WebLinkAboutRESOLUTION - 49-92 - 7/28/1992 - AMERICANS WITH DISABILITIES ACTRESOLUTION NO. 49-92 A RESOLUTION ADOPTING AMERICANS WITH DISABILITIES ACT GRIEVANCE POLICY (ADA) NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Village President and Board of Trustees hereby adopt the document entitled: Americans With Disabilities Act Grievance Policy (ADA) copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. Zettek Village President AMERICANS WITH DISABILITIES ACT GRIEVANCE POLICY Purpose and Compliance Officer Designation The Americans With Disabilities Act (ADA) allows individuals who have a grievance regarding the Village's compliance with the ADA to file a grievance with the ADA Compliance Officer. The Compliance Officer will investigate the grievance and report the appropriate action taken, if any, to resolve the complaint. For all purposes, the Village designates its Assistant Village Manager as the Compliance Officer responsible for handling all ADA inquiries filed with the Village. Any non-employee with an inquiry regarding the Village's compliance with the ADA must complete a grievance procedure form available at the Village Clerk's office (Administration Counter) at the Municipal Complex. b. Any Village employee with an inquiry regarding the Village's compliance with the ADA must do so through the Village's Employee Communication Procedure as outlined in the Village Personnel Rules and Regulations, Section 9.17. 2. a. The completed grievance procedure form is to be returned to the Village Clerk's office and routed to the designated ADA Compliance Officer. b. Any supervisor receiving an inquiry regarding ADA compliance through the Employee Communication Procedure shall refer the details of the grievance to the Compliance Officer. 3. The Compliance Officer will promptly conduct an investigation of the grievance. The Compliance Officer will determine and document the action taken to resolve the grievance, if any. 4. The Compliance Officer will contact the grievant within 5 working days regarding the status of the investigation and, if necessary, at regular intervals until such time as a final decision is made on the complaint. 5. All documentation regarding each complaint will be kept on file for a minimum of three years. Appeal from ADA Compliance Officer Findings 1. If the grievant is not satisfied with the decision rendered by the Compliance Officer with respect to their complaint, the grievant may request an appeal of the decision to the Village Manager. 2. The Village Manager will review the appeal and inform the grievant of the final decision within two weeks of the request.
