A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE
CLERK TO EXECUTE AN AGREEMENT BETWEEN THE VILLAGE OF ELK
GROVE VILLAGE AND THE ELK GROVE VILLAGE PUBLIC LIBRARY
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State of
Illinois as follows:
Section 1: That the Village President be and is hereby authorized
to sign the attached documents marked:
AGREEMENT
PERSONNEL LIFT
a copy of which is attached hereto and made a part hereof as if fully set
forth and the Village Clerk is authorized to attest said documents upon the
signature of the Village President.
Section 2: That this Resolution shall be in full force and effect
from and after its passage and approval according to law.

AGREEMENT
The VILLAGE OF ELK GROVE VILLAGE, an Illinois Municipal Cor-
poration (hereinafter "Village" ) and the ELK GROVE VILLAGE PUBLIC
LIBRARY, an Illinois Municipal Corporation (hereinafter "Library" )
in consideration of the mutual promises and conditions hereinafter
set forth and other good and valuable consideration the receipt
of which is hereby acknowledged do hereby agree to jointly pur-
chasing a personnel lift subject to the following terms and con-
ditions :
1. All costs, including initial purchase price, mainte-
nance and repair shall be shared equally between the
Village and the Library, provided however that repairs
necessitated by the negligence or improper usage of
either the Village or the Library shall be paid for
solely by the responsible party.
2. The Village shall hold title to the lift and shall
store the lift in its public works facility. The
Village shall deliver the lift to the Library at
their request within 72 hours after receiving their
request, and the Library will make all reasonable
efforts to schedule their use of the lift so that
the delivery/pick up efforts by the Village will be
kept to a minimum. The Village shall also be re-
sponsible for picking up the lift at the termina-
tion of the Library' s use.
3 . Emergency use of the lift shall receive priority
over routine use.
4 . Proper training and use is the sole responsibility
of the respective municipal entity.
5 . The Village and the Library agree to hold each other
harmless from any and all claims and expenses , in-
cluding cost of litigation resulting from the use
of the lift by either municipal entity. All claims,
including worker ' s compensation claims shall be
handled by the Village and the Library through their
respective insurance carriers.
IN WITNESS WHEREOF, the parties hereto set forth their hands
and seals this 9th day of September , 1992 .
