HomeMy WebLinkAboutRESOLUTION - 18-91 - 3/26/1991 - LETTER OF UNDERSTANDING/IDOTRESOLUTION NO. 18-91 A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE CLERK TO EXECUTE A LETTER OF UNDERSTANDING WITH THE STATE OF ILLINOIS DEPARTMENT OF TRANSPORTATION FOR THE ELGIN-O'HARE EXPRESSWAY (F.A.P. 345) AT MEACHAM/MEDINAH ROAD NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Village President be and is hereby authorized to sign the attached documents marked: "Letter of Understanding" Elgin -O'Hare Expressway (F.A.P. 345) at Meacham/Medinah Road a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. Section 2: That the Director of Engineering and Community Development be and is hereby authorized to sign the Plan Approval Certificate. Zettek, Jr. President Elk Grove Village 901 Wellington Avenue Elk Grove, IL 60007 Dear Mr. Zettek: The State is desirous of the realignment of Road at the proposed Elgin -O'Hare Expressway Counties of Cook and DuPage, Illinois (State making the following improvements: A. Meacham/Medinah Road @ F.A.P. Route 345 Meacham Road/Medinah (F.A.P. 345) in the Section: 16-2-2) by n -O'Hare oa way realignment to provide Meacham/Medinah Road with two 12' and variable width through traffic lanes in each direction separated by a 30' and variable width median. Northbound Meacham/Medinah Road will be provided with one 12' right turn lane at Eastbound Frontage Road, one 12' left turn lane at the Elgin -O'Hare westbound entrance ramp and one 12' left turn lane at Virginia Drive. Southbound Meacham/Medinah Road will be provided with one 12' left turn lane at Virginia Drive, one 12' left turn lane at Haar Lane, one 12' left turn lane at Roosa Lane, one 12' right turn lane at the Elgin -O'Hare westbound entrance ramp, two 12' left turn lanes at Eastbound Frontage Road and one 12' left turn lane at relocated Crest Avenue. Crest Avenue will be relocated to create a "T" intersection with Meacham/Medinah Road and will be provided with one 12' through traffic lane in each direction separated by thermoplastic pavement marking. Traffic signals will be installed along Meacham/Medinah Road at Eastbound Frontage Road/Eastbound Elgin -O'Hare exit ramp and at westbound Frontage Road/Elgin-O'Hare entrance ramp. Interchange lighting will be included at Meacham/Medinah Road at F.A.P. 345 (Elgin -O'Hare Expressway). Grading, drainage, utility relocation, and roadway signing.will be included throughout as well as all other work necessary to complete the improvement in accordance with the approved plans and specifications. In order that the State and the Village may benefit by this proposed improvement, we are requesting concurrence with the following: Mr. Charles J. Zettek, Jr. Page Two 1. The State agrees to perform all Phase I and Phase II engineering, make the surveys, obtain all necessary rights of way, secure any and all required permits and prepare the plans and specifications. 2. The State agrees to be responsible for all costs associated with Phase I Engineering, Phase II Engineering and any and all required right of way. In essence, the State will be responsible for all costs associated with the functions necessary to have the contracts ready for a County letting. Cook County will be responsible for all costs associated with the functions required to let, award, construct, inspect and complete the contract and pay for all costs associated with construction and construction engineering, except as noted above. 3. Upon completion of the improvement and final field inspection by the State and so long as Meacham/Medinah Road is used as a County Route, the County of Cook agrees to maintain Meacham/Medinah Road (within Cook County) in its entirety (within project limits). Upon completion of the improvement and final field inspection by the State and so long as Meacham/Medinah Road and Crest Avenue is used as a DuPage County Route, the County of DuPage agrees to maintain Meacham/Medinah Road and Crest Avenue (within DuPage County) in their entirety (within project limits). Upon completion of the improvement and final field inspection by the State, the State will maintain, or cause to be maintained those portions of the Elgin -O'Hare Expressway constructed as part of this improvement. 4. The State will cause private utilities to be relocated at no expense to the State or Village. Where a municipal utility has been installed (1) on right of way acquired by the Illinois Department of Transportation or (2) within defined limits of a route the Illinois Department of Transportation has accepted for maintenance responsibilities, subsequent to the date of such acceptance, the municipality will bear all utility relocation or adjustment costs made necessary by the construction of this improvement. 5. Upon acceptance by the State of the new traffic signal installations, the financial responsibility for maintenance and electrical energy for the operation of the signals shall be proportioned as follows: Intersection Level of Maintenance Electrical ain enance nergy I or II Village Share . . . . . I or II 100% 0% . 0% 100% It is mutually agreed that the actual signal maintenance will be performed by the State either with its own forces or through an ongoing contractual agreement. The parties hereto agree that the traffic signal maintenance and energy provisions of this agreement shall remain in effect for a period of twenty (20) years from the date of its execution, or so long as the traffic signals covered by the terms of this agreement of any amendment hereto remain in place either in their current or some modified configuration, whichever is the shorter period of time. Such an effective term shall apply unless otherwise agreed in writing by the parties hereto. The State agrees to make arrangements with the local power company to furnish the electrical energy for the operation of the traffic signals. The Village agrees to pay its share of this costs as billed by the local power company. The State retains the right to control the sequence and timing of all the traffic signals included herein. 6. The Village will adopt and put into effect the following ordinances: a. Parking will be prohibited within that portion of the improvement falling within the Village limits of the improvement. b. Storm sewer, sanitary sewer and industrial waste water connections into any drainage facility constructed as part of the improvement are prohibited. C. Encroachments will be prohibited. d. Plan approval (letter will be satisfactory). This Letter of Understanding shall become null and void in the event the contract covering the construction is not awarded by July 1, 1994. r Mr. Charles J. Zettek, Jr. Page Four Approval of this Letter of Understanding shall be considered as concurrence with and acceptance of the terms contained herein and shall be binding upon and inure to the benefit of the parties hereto, their successors and assigns.
