A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE
CLERK TO EXECUTE AN AGREEMENT BETWEEN THE VILLAGE OF ELK
GROVE VILLAGE AND I.D.O.T. FOR IMPROVEMENTS TO ELMHURST ROAD
FROM ESTES AVENUE TO LANDMEIER ROAD AND ILLINOIS ROUTE 72
FROM LANDMEIER ROAD TO ELMHURST ROAD
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State
of Illinois as follows:
Section 1: That the Village President be and is hereby authorized
to sign the attached documents marked:
AGREEMENT
Elmhurst Road from Estes Avenue to Landmeier Road
and
Illinois Route 72 from Landmeier Road to Elmhurst Road
a copy of which is attached hereto and made a part here)f as if fully set
forth and the Village Clerk is authorized to attest said documents upon the
signature of the Village President.
Section 2: That this Resolution shall be in full force and effect
from and after its passage and approval according to law.

AGREEMENT
THIS AGREEMENT entered into this 25th day of June A•D•
1991 , by and between the STATE OF ILLINOIS, acting by and through its
DEPARTMENT OF TRANSPORTATION, hereinafter called the STATE, and the Village of
Elk Grove Village, County of Cook, of the State of Illinois, hereinafter
called the VILLAGE.
WITNESSETH:
WHEREAS, the STATE and the VILLAGE in order to facilitate the free flow of
traffic and ensure safety to the motoring public, is desirous of improving
Illinois Route 72 (FAP 341) from Landmeier Road to Elmhurst Road (FAU 2678),
and by improving Elmhurst Road (FAU 2678) from Greenleaf Avenue to Landmeier
Road, STATE Section: (31 & 3035) N-89, VILLAGE Section: 91 -00034 -00 -EG,
STATE Job No. C-91-414-89 by making the following improvements:
Illinois Route 72 - Landmeier Road to Elmhurst Load
The improvement will consist of the reconstruction of Illinois Route 72 from
Landmeier Road to Elmhurst Road. The intersection of Illinois Route 72 at
Elmhurst Road will be widened to provide three twelve foot through lanes in
each direction, dual left turn bays at each approach, and a four foot barrier
median, and a right turn lane for west -northbound and southwestbound traffic.
The three westbound through traffic lanes on Illinois Route 72 will be
extended through Landmeier Road then taper to two lanes.
Curb and gutter will be constructed along Illinoi, Route 72. The intersection
of Illinois Route 72 and Elmhurst Road will be improved to a one hundred foot
cross section three twelve foot through lanes, two twelve foot left turn lanes
on the west and north approaches and a one hundred twelve foot cross section
on the east and south approaches will provide three twelve foot through, two
twelve foot left and one twelve foot right turn lanes. The existing traffic
signal will be modernized. Lighting will be installed at the intersection of
Illinois Route 72 and Elmhurst Road. The intersection of Illinois Route 72
and Touhy Avenue will be improved to provide additional turn bay storage.
Elmhurst Road - Greenleaf Avenue to Landmeier Road
The improvement will consist of the reconstruction of Elmhurst Road from
Greenleaf Avenue to Landmeier Road. Curb and gutter will be constructed along
Elmhurst Road. Elmhurst Road at Estes Avenue will be improved to provide turn
bay channelization on Elmhurst Road. Improvements to Elmhurst Road at Old
Higgins Road will include barrier median along Elmhurst Road to prevent
through movements on Old Higgins Road and left turn movements onto Old Higgins
Road. All other work necessary to complete the improvement in accordance with
the approved plans and specifications will also be performed.
WHEREAS, the STATE and VILLAGE are desirous of said improvement in that
same will be of immediate benefit to the VILLAGE residents and permanent in
nature;
NOW, THEREFORE, in consideration of the mutual covenants contained herein,
the parties agree as follows:
1. The VILLAGE agrees to prepare detailed construction plans and specifications
for the improvement for pro:essing by the STATE subject to full reimburse-
ment by the STATE in accordance with previously approved Joint Agreements
and addenda thereto.
2. The STATE agrees to assemble the plans and specifications into a contract
suitable for bidding of a STATE contract, process, receive bids and award
the contract, furnish engineering inspection during construction and cause
the improvement to be built in accordance with the plans, specifications,
and contract.
3. The STATE agrees to acquire and pay all right-of-way, construction and
construction engineering cos.s subject to reimbursement by the VILLAGE as
hereinafter stipulated.
4. The VILLAGE agrees to reimburse the STATE for 100% of all construction and
construction engineering costs associated with the relocation of two
VILLAGE owned fire hydrants and five VILLAGE owned water service boxes.
5. It is mutually agreed by and between the parties hereto that the estimated
cost of the improvement is as shown on Page 2A.

Note: The VILLAGE is responsible for all preliminary engineering functions subject
to reimbursement by the STATE.
The VILLAGE participation shall be predicated on the percentages shown above
for the specified work. The VILLAGE cost shall be determined by multiplying
the final quantities times contract unit prices plus 10% for construction
engineering.
The VILLAGE participation toward all VILLAGE owned utility relocations and
adjustnents shall not exceed $11,000 which represents 125% of the estimated
- construction and construction engineering -costs,
6. The VILLAGE has passed a resolution appropriating sufficient funds to pay
its share of the cost of this improvement, a copy of which is attached
hereto as Exhibit A and made a part hereof.
Upon award of the contract for this improvement, the VILLAGE will pay
to the Department of Transportation of the State of Illinois in a lump
sum, from any funds allotted to the VILLAGE an amount equal to 95% of its
obligation incurred under this agreement and will pay to said Department
the remainder of its obligation in a lump sum upon completion of the
project, based upon final cost.
The VILLAGE agrees to pass a supplemental resolution to provide
necessary funds for its share of the cost of this improvement it the
amount appropriated herein proves to be insufficient to cover said cost.
7. The VILLAGE adopted and will put into effect prior to the STATE
advertising for the work to be performed hereunder, an ordinance requiring
that parking be prohibited along Illinois Route 72 and Elmhurst Road
within the limits of this improvement, within the VILLAGE limits, a copy
of which is attachec hereto as Exhibit B and made a part hereof, and will
in the future prohibit parking at such locations on or immediately
adjacent to this improvement as may be determined by the STATE or be
necessary from traffic capacity studies.
8. The VILLAGE has adopted and will put into effect, prior to the STATE
advertising for the work to be performed hereunder, an appropriate
ordinance prohibiting the discharge of sanitary and industrial waste water
into any storm sewers or drainage facility constructed as part of this
improvement, a copy of which is attached hereto as Exhibit C and made a
part hereof.
9. Prior to the STATE advertising for the work to be performed hereunder, the
disposition of encroachments will be cooperatively determined by
representatives from the VILLAGE and the STATE.
The VILLAGE has adopted and will put into effect, prior to the STATE
advertising for the work to be performed hereunder, an appropriate
ordinance relative to the disposition of encroachments and prohibiting in
the future any new encroachments within the limits of the improvement, a
copy of which is attached as Exhibit D and made a part hereof.
10. The VILLAGE agrees not to permit driveway entrance openings to be made in
the curb as constructed, without the consent of the STATE.
11. The STATE shall cause private utilities to be relocated at no expense to
the STATE or VILLAGE. Where a municipal utility has been installed (1) on
right of way acquired by the STATE or (2) within defined limits of a route
the STATE has accepted for maintenance responsibilities, subsequent to the
date of such acceptance the municipality will bear all utility relocation
or adjustment costs made necessary by the construction of this improvement.
12. Upon completion of the improvement and final field inspection by the STATE
and so long as Illinois Route 72 and Elmhurst Road are used as STATE
highways, the STATE agrees to maintain, or cause to be maintained, the
medians, the through traffic lanes, the left -turn and right -turn lanes,
and the curb and gutter or stabilized shoulders and ditches adjacent to
those lanes. The STATE will be responsible for the maintenance of lane
line and median line markings.
13. Upon completion of the improvement and final field inspection by the
STATE, the VILLAGE agrees to maintain, or cause to be maintained, along
Illinois Route 72 and Elmhurst Road within the VILLAGE limits, those
portions of the improvement which are not to be maintained by the STATE,
including sidewalks, parkways, landscaping, manholes, catch basins, storm
sewers, utilities, crosswalk, stopline markings, and appurtenances. The
VILLAGE further agrees to perform those functions necessary to keep the
sewer in a serviceable condition including cleaning sewer lines, inlets,
manholes, and catch basins along with the repair or replacement of inlet,
manholes, and catch basins' frames, grates, or lids plus structural
failures to a maximum length of twelve feet between adjacent manholes.
The VILLAGE and STATE shall share the cost of maintenance, except as
aforedescribed, repair and/or reconstruction of the joint use sewer(s) to
the same proportioning as the sewers initial construction costs were
proportioned.
14. Upon acceptance by the STATE of the traffic signal work included herein,
the financial responsibility for the maintenance and electrical energy
charges for the operation of the signals shall be proportioned as follows:

It is mutually agreed that the actual signal maintenance will be performed
by the STATE, either with its own forces or through an ongoing contractual
agreement.
It is further agreed that the signals shall be maintained to the Level of
Maintenance shown above.
It is understood that Level of Maintenance I meets the minimum
requirements of the Illinois Manual on Uniform Traffic Control Devices for
Streets and Highways and Level of Maintenance II exceeds the manual
requirements and is prescribed for those signals that the District
Engineer, with the concurrence of the Engineer of Traffic, determines to
require a higher level of service for adequate operations of the highway
system at those locations.
15. Upon c+.mpletion of the improvement and final field inspection by the
STATE, the VILLAGE agrees to maintain, or cause to be maintained, the new
highway lighting facilities in their entirety. The VILLAGE will also be
responsible for the energy costs for the lighting.
16. The STATE shall be responsible for relocation of the new highway lighting
system in the future if another highway improvement requires its
relocation. This will be in effect for twenty years from the execution
date of this agreement. After this time, the VILLAGE will be sole owners
of the lighting system in its entirety and become a VILLAGE owned utility.
THIS AGREEMENT and the covenants contained herein shall become null and
void in the event the contract covering the construction work contemplated
herein is not awarded by July 1, 1994.
THIS AGREEMENT shall be binding upon and inure to the benefit of the
parties hereto, their successors and assigns.
