A RESOLUTION OPPOSING LAND USE CONTROLS BY THE CITY OF
CHICAGO, FEDERAL AVIATION ADMINISTRATION AND AIRLINES
IN JURISDICTIONS SURROUNDING O'HARE AIRPORT
WHEREAS, historically local regulation of zoning received general
acceptance in the early and mid -1920's; and
WHEREAS, the earliest zoning principles held that an individual cannot
use his land to injure a neighbor's land; and
WHEREAS, the incorporation of municipalities surrounding what is now
O'Hare International Airport, is as follows Addison (1884), Bensenville
(1884), Des Plaines (1925), Elk Grove Village (1956), Park Ridge (1910),
Wood Dale (1928), Franklin Park (1892), and Schiller Park (1914); and
WHEREAS, the Illinois Legislature and Illinois Constitution delegate
responsibility for land use planning to cities, villages and counties; and
WHEREAS each jurisdiction has implemented a comprehensive plan which
has become the basis for zoning regulations as adopted by respective
locally elected officials; and
WHEREAS, zoning ordinances address the concerns of noise, noxious
fumes, and other factors derived from land uses; and
WHEREAS, the regulation of land use impacts the quality of life in our
communities; and
WHEREAS, the precursor of O'Hare International Airport, Orchard Field,
was officially opened in 1955; and
WHEREAS, many of the land uses which exist in jurisdictions surrounding
O'Hare existed prior to the operation of what is now O'Hare; and
WHEREAS, much of the future development in the area immediately
adjacent to O'Hare will conform to existing land use patterns because it is
primarily "in fill" development of small vacant land parcels; and
WHEREAS, the City of Chicago has undertaken a federally funded noise
compatibility study commonly referred to as the Part 150 Study; and
WHEREAS, the goal of the Part 150 Study is to develop a balanced and
cost-effective program to minimize and/or mitigate O'Hare Airport's noise
impact on the local communities; and
WHEREAS, the Part 150 Study includes the evaluation of airport and
aircraft operational measures and land use measures (including zoning) to
reduce the effects of noise and air pollution on the surrounding
jurisdictions; and
WHEREAS, the suburban representatives have requested that airport and
aircraft operational measures be evaluated before consideration of any land
use measures; and
WHEREAS, the operator of O'Hare, the City of Chicago, has not
implemented procedures to mitigate noise and air pollution such as
nighttime curfews, aircraft operational limits, aircraft fleet mix, and
arrival/departure profiles; and
WHEREAS, suburban representatives are concerned that the Part 150 Study
should not be used as a means of eliminating the rights of persons who live
near O'Hare thereby abrogating what is an appropriate responsibility of the
City of Chicago, the Federal Aviation Administration and the airlines; and
WHEREAS, a proposal has been made by the City of Chicago to expand
O'Hare Airport by the addition of new runways: and
WHEREAS, expanded airport operations will increase the negative impact
on currently affected areas, further extend noise impacts to additional
communities and residents, and make even more difficult the completion of
the Part 150 Study and its implementation.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage; State of
Illinois:
Section 1: That the planning process for O'Hare International
Airport must take into account the needs of surrounding jurisdictions.
Section 2: That the City of Chicago should take appropriate action
to reduce noise and air pollution problems.
Section 3: That all airport and aircraft operational measures should
be taken by the City of Chicago and the airlines to reduce noise and air
pollution before any locally controlled land use measures are further
discussed.
Section 4: That land use planning and zoning must remain a local
concern controlled by locally elected officials without interference by the
City of Chicago, Federal Aviation Administration or the airlines of O'Hare.
