HomeMy WebLinkAboutRESOLUTION - 45-90 - 7/24/1990 - IDOT AGRMT/TRAFFIC SIGNAL SYSTEMRESOLUTION NO. 45-90 A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE CLERK TO EXECUTE A LETTER OF UNDERSTANDING FROM THE ILLINOIS DEPARTMENT OF TRANSPORTATION FOR THE CONSTRUCTION OF A CLOSED LOOP SIGNAL SYSTEM ALONG ILLINOIS ROUTE 83 (BUSSE ROAD) FROM THIRD AVENUE IN BENSENVILLE TO HOWARD STREET IN ELK GROVE VILLAGE NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Village President be and is hereby authorized to sign the attached documents marked: ILLINOIS DEPARTMENT OF TRANSPORTATION LETTER OF UNDERSTANDING a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. Zettek Jr., President Elk Grove Village 901 Wellington Avenue Elk Grove, IL 60007 Dear Mr. Zettek: The Illinois Department of Transportation has developed a traffic signal improvement program named Operation Green Light to improve the operation of existing signalized intersections in northeastern Illinois. This program is part of the 1989 motor fuel tax package approved by the General Assembly and signed by the Governor. Operation Green Light will install "Closed Loop" traffic signal systems to improve vehicle progression between adjacent signalized intersections and reduce overall delay to the motoring public. A "Closed Loop" traffic signal system is tentatively scheduled for installation on IL Rte 83 from Howard Street to Third Avenue under State Section 1989-070TS in Elk Grove Village, Village of Bensenville and City of Wood Dale. The scope of work consists of installing a nardwire inter- connect, a Master Controller, system detector loops, and upgrading the existing traffic signal control equipment at the following intersections. The copy is for your file. Elk Grove Village of Cook County of the State of Illinois, hereinafter referred to as the VILLAGE and the State of Illinois, hereinafter referred to as the STATE, mutually understand and agree to the following: 1. The STATE agrees to make the surveys, prepare plans and specifications, receive bids, award the contract, furnish engineering inspection during construction, and cause the improvement to be built in accordance with the plans, specifications, and contract. 2. The estimated cost of this traffic signal improvement is as follows: Construction Costs $545,000.00 Engineering Costs (15%) 81,750.00 Total $626,750.00 3. As part of the 1989 motor fuel tax package, the STATE agrees to pay all construction and engineering costs for the traffic signal improvement, except when a new traffic signal is installed. Under the STATE'S normal policy, the estimated cost to the VILLAGE would have been $82,831. This amount was determined on Page 2A. 4. The VILLAGE agrees to approve the plans and specifications by letter or resolution prior to the STATE advertising for the work to be performed hereunder. 5. The traffic signals shall be maintained at Level of Maintenance II. It is understood that Level of Maintenance I meets the minimum requirements of the Illinois Manual on Uniform Traffic Control Devices for Streets and Highways and Level of Maintenance II exceeds the Manual requirements and is prescribed for those signals that the District Engineer, with the concurrence of the Engineer of Traffic determines to require a higher level of service for adequate operations of the highway system at those locations. -4- 6. The VILLAGE agrees to be billed by the STATE for its proportionate share of the traffic signal maintenance costs on a three-month basis. Upon receipt of the invoice, the VILLAGE agrees to reimburse the STATE in the amount of the bill made payable to the "Treasurer of the State of Illinois". 7. The parties hereto agree that the traffic signal maintenance and energy provisions of this Letter of Understanding shall remain in effect for a period of twenty (20) years from the date of its execution or so long as the traffic signals covered by the terms of this Letter of Understanding or any Amendment hereto remain in place either in their current or some modified configuration, whichever is the shorter period of time. Such an effective term shall apply unless otherwise agreed in writing by the parties hereto. 8. The STATE retains the right to control the sequence and timing of the traffic signals included herein. 9. The VILLAGE agrees to pay 100% of the electrical energy charges for the operation of the traffic signals assigned in Item 5. The local power company shall bill the VILLAGE directly for the electrical energy charges. 10. The VILLAGE has in effect or will adopt prior to advertising for the work to be performed hereunder, an ordinance requiring that parking be prohibited adjacent to this improvement on the approaches lying within the corporate limits of the VILLAGE, and will in the future, prohibit parking at such locations on or immediately adjacent to this improvement as may be determined to be necessary by the STATE from traffic capacity studies. 11. The VILLAGE agrees to maintain stop bars and crosswalks on all approaches lying within the corporate limits of the VILLAGE for this improvement. The STATE agrees to maintain lane lines and median line markings on STATE maintained routes. 12. The VILLAGE agrees to exercise its franchise right to cause private utilities to be relocated at no expense to the STATE. -5- 13. This Letter of Understanding shall become null and void in the event the contract covering the construction work contemplated herein is not awarded by June 1, 1993. 14. This Letter of Understanding and the covenants contained herein shall be binding upon and inure to the benefit of the parties hereto, their successors and assigns. Very truly yours, CO/ James C.
