NATIONAL NOISE POLICY RESOLUTION NO. 79-90 A RESOLUTION OPPOSING THE ESTABLISHMENT OF A NATIONAL NOISE POLICY BY THE VILLAGE OF ELK GROVE VILLAGE WHEREAS, the Village of Elk Grove Village represents over 32,000 people, all of whom live in areas impacted by aircraft noise from Chicago' s O'Hare International Airport; and WHEREAS, the environmental impact of noise pollution from O'Hare was found to be so great that the federal government required that a Part 150 Noise Compatibility Study be conducted as a condition of O' Hare expansion; and WHEREAS, the Airport Committee has participated with the O'Hare Advisory Committee in the Part 150 Study for the last several years with the goal of producing a plan which will lessen O' Hare noise impacts on Elk Grove Village residents; and WHEREAS, Senate Bill 3094 was proposed by Senator Wendell Ford (D-KY) for the purpose of establishing a national noise policy; and WHEREAS, this bill requires as a precondition for establishing a passenger facility charge, that such a national noise policy be established; and WHEREAS, this national noise policy as described in the Bill would prohibit any regulation of Stage 3 aircraft including, but not limited to, any restriction on noise levels of any type, any limit on operations, any noise budgets or noise allocation programs, or any limits on hours of operation; and WHEREAS, this Bill eliminates any local regulation of airport noise, including any existing regulations which may be in effect at O'Hare Airport; and WHEREAS, this Bill may impact local land use regulations; and WHEREAS, this Bill provides for the airlines to be released from liability and further provides for the transfer of that liability to the federal government and the federal taxpayers; and WHEREAS, the Bill provides for the airlines to sue local airport authorities for compliance with this act and allows funds to be withheld from local airport proprietors who do not comply with the act; and WHEREAS, this Bill is tied to the federal budget compromise which must be considered by the U. S. Congress: and WHEREAS, this Bill asserts that community noise concerns have placed an undue burden on the airline industry; and WHEREAS, the Part 150 Study currently underway for O' Hare would be destroyed by this Bill because any restrictions which could be agreed upon by all parties would be prohibited by this act; and WHEREAS, there have been no public hearings on this proposal and no opportunity for the public to comment on regulations which would greatly impact many citizens around the country. NOW, THEREFORE, BE IT RESOLVED BY THE President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Village of Elk Grove Village opposes Senate Bill 3094 and establishment of a national noise policy and urges all area legislators to vote against this Bill and any amendments which restrict the rights of local governments to establish noise controls on area airports or in other ways work toward the reduction of aircraft noise impacts on citizens who live and work in noise impact areas. Section 2: That the Village Clerk is hereby authorized to send a copy of this Resolution to Governor James R. Thompson, Senator Paul R. -2- Simon, Senator Alan J. Dixon, Representative Henry J. Hyde and Representative Harris W. Fawell . Section 3: That this Resolution shall be in full force and effect from and after its passage and approval according to law.
