HomeMy WebLinkAboutRESOLUTION - 81-90 - 12/11/1990 - AGRMT/ROHLWING IMPROVEMENT/IDOT RESOLUTION NO. 81-90 A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE CLERK TO EXECUTE AN AGREEMENT WITH THE ILLINOIS DEPARTMENT OF TRANSPORTATION FOR ROHLWING ROAD IMPROVEMENT NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Village President be and is hereby authorized to sign the attached documents marked: AGREEMENT ROHLWING ROAD IMPROVEMENT (SBI 53, STATE Section: 5328-90, STATE Job No. : C-91-281-90) a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. Section 2: That the Director of Engineering and Community Develop- ment be and is hereby authorized to sign the Plan Approval provided that the changes requested by the Village, in its October 9, 1990 letter to the District Engineer, are incorporated in the plans and specifications currently being revised by the STATE. Section 3: That this Resolution shall be in full force and effect from and after its passage and approval according to law. Smith Village Clerk 2711r AGREEMENT THIS AGREEMENT entered into this 11th day of December A.D. 1990 by and between the STATE OF ILLINOIS, acting by and through its DEPARTMENT OF TRANSPORTATION, hereinafter called the STATE, and ELK GROVE VILLAGE, County of Cook, of the State of Illinois, hereinafter called the VILLAGE. WITNESSETH: WHEREAS, the STATE, in order to facilitate the free flow of traffic and ensure safety to the motoring public, is desirous of improving approximately 1822 linear feet of Rohlwing Road from Helen Lane to approximately 290 l.f. north of White Trail Lane in Elk Grove Village, Cook County, Illinois [SBI 53, STATE Section: 532R-90, STATE Job No.: C-91-281-901 by making the following improvements: A. Rohlwing Road - from Helen Lane to north of White Trail Lane (approximately 290 l.f. north of White Trail Lane which is the south corporate limit of the Village of Schaumburg) : Roadway widening to provide two 12' through traffic lanes in each direction separated by a 16' and variable width median complete with curb and gutter. Rohlwing Road @ White Trail Lane will be provided with a left turn lane to accommodate northbound to westbound traffic movements. The north terminus of Rohlwing Road will end at the south corporate limits of the Village of Schaumburg and will match the proposed cross section to the north (which will be constructed as a separate project by the Village of Schaumburg) and by performing all other work necessary to complete the improvement in accordance with the approved plans and specifications; and WHEREAS, the VILLAGE is desirous of said improvement in that same will be of immediate benefit to the VILLAGE residents and permanent in nature; NOW, THEREFORE, .in consideration of the mutual covenants contained herein, the parties hereto agree as follows: 1. The STATE agrees to make the surveys, obtain all necessary rights of way, prepare plans and specifications, receive bids and award the contract, furnish engineering inspection during construction and cause the improvement to be built in accordance with the plans, specifications and contract. 2. The STATE agrees to pay all right-of-way, construction and engineering costs associated with the project. 3. The VILLAGE has adopted and will put into effect, prior to the STATE advertising for the work to be performed hereunder, an appropriate ordinance prohibiting the discharge of storm, sanitary and industrial waste into any storm sewers or drainage facility constructed as part of this improvement, a copy of which is attached hereto as Exhibit A and made a part hereof. 4. The VILLAGE agrees to adopt a resolution or send a letter, prior to the STATE advertising for the work to be performed hereunder, approving the plans and specifications as prepared. 5. The STATE shall cause private utilities to be relocated at no expense to the STATE or VILLAGE. 6. The VILLAGE and STATE have agreed to a jurisdictional transfer of Rohlwing Road (from Biesterfield Road to approximately 290 l.f. north of White Trail Lane, which is also the south corporate limit of the Village of Schaumburg). A copy of the jurisdictional transfer is attached hereto as Exhibit B (BLR 1600). -2- Upon completion of the improvement and final field inspection by the STATE and notification by the District Engineer, the VILLAGE will assume jurisdiction of Rohlwing Road - from the north edge of pavement of Biesterfield Road to approximately 290 l.f. north of White Trail Lane which is the south corporate limit of the Village of Schaumburg. The VILLAGE has adopted and will put into effect prior to the STATE advertising for the work to be performed hereunder, an appropriate ordinance adding that portion of roadway described above and identified on Exhibit B to its VILLAGE system. A copy of said ordinance is attached hereto and made a part hereof. 7. In pursuit of highway system continuity and in consideration for the VILLAGE assuming jurisdiction of Rohlwing Road as described in Item #6, the STATE is desirous of assuming jurisdiction of Biesterfield Road (from the west edge of pavement of Rohlwing Road to the east edge of pavement of Martha Street). A copy of the jurisdictional transfer is attached hereto as Exhibit C (BLR 1600). Upon completion of the improvement (to Rohlwing Road as described in this agreement) and final field inspection by the STATE and notification by the District Engineer, the STATE will the west edge of p+uelne t Cf assume jurisdiction of Biesterfield Road - from.Rohlwing Road to eac the west edge of pavement of Martha Street. Said jurisdiction will include the structure passing over I-290 in its entirety. The VILLAGE has adopted and will put into effect prior to the STATE advertising for the work to be performed hereunder, an appropriate ordinance deleting that portion of roadway described above and identified on Exhibit C from its VILLAGE system. A copy of said ordinance is attached hereto and made a part hereof. THIS AGREEMENT and the covenants contained herein shall become null and void in the event the contract covering the construction work contemplated herein is not awarded by July 1, 1992. -3- THIS AGREEMENT shall be binding upon and inure to the benefit of the parties hereto, their successors and assigns.
