A RESOLUTION AUTHORIZING THE PRESIDENT AND CLERK TO EXECUTE
A PERMANENT DRAINAGE EASEMENT AGREEMENT AND A CONSTRUCTION
PERMIT AGREEMENT BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND
THE COUNTY OF COOK, A BODY POLITIC, AND CORPORATE OF THE STATE
OF ILLINOIS FOR DIERKING TERRACE
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State of
Illinois:
Section l : That the Village President be and is hereby authorized
to sign the attached documents marked:
"DRAINAGE EASEMENT"
and
"CONSTRUCTION PERMIT"
a copy of which is attached hereto and made a part hereof as if fully set
forth and the Village Clerk is authorized to attest said documents upon
the signature of the Village President.
Section 2: That this Resolution shall be in full force and effect
from and after its passage and approval according to law.

Dear Mr. Zettek:
The Cook County Highway Department is planning to widen and improve Landmeier
Road from Busse Road to Higgins Road. A part of this improvement will be
the construction of a 60" circular to 76" x 48" elliptical storm sewer Main
Drain and Headwall. The Main Drain will be constructed within Dierking
Terrace right of way which is a Village Street. This improvement will
require the County to obtain a permancent drainage easement and a Con-
struction Permit from the Village.
We are enclosing three (3) copies of the subject Easement document and
and Construction Permit for your approval and execution.

CONSTRUCTION PERMIT
THIS INDENTURE WITNESSETH: That Grantor, The Village of
Elk Grove, an Illinois corporation , for and in consideration
of the sum of ONE DOLLAR ( $1. 00 ) and other good and valuable
consideration, receipt of which is hereby acknowledged, paid
by and for the County of Cook, a body politic, and corporate
of the State of Illinois , Grantee herein, hereby gives and grants ,
but without warranty, subject to the reservations , conditions
and provisions hereinafter contained, unto Grantee a Construction
Permit across the following tract of land in Section 26,
Township 41 North, Range 11 East of the Third Principal Meridian
to-wit : LANDMEIER ROAD

That part of Lot 1 in the REsubdivision of Lots 1 and 2 in Everding
Subdivision of parts of the Southwest Quarter of Section 26 ,
Township 41 North, Range 11 East of the Third Principal Meridian,
bounded and described as follows :
Beginning at a point on the North line of said Lot 1 that is 40
feet West of the Northeast corner thereof; thence South at right
angles to said North line 30 feet ; thence Southwesterly to a
point that is 40 feet West of and 35 feet South of the point of
beginning ( as measured along the North line of said Lot 1 and
on a line at right angles thereto ) ; thence North along said right
angle line 35 feet to the North line of said Lot 1; thence East
along said North line 40 feet to the place of beginning, in rnnk
County, Illinois .
as indicated on Exhibit "A" attached hereto and made a part hereof,
provided that said construction shall be in substantial conformity
with the plans shown hereon.
GRANTEE hereby reserves unto itself, its grantees , licensees ,
successors and assigns , the unrestricted right for ingress to and
egress from Grantor' s adjoining properties and also the right to
install, operate, maintain, renew and remove its or their facili-
ties upon, over and under the surface of said described tract of
land, and to make such other and further use of said tract of
land, as it or they shall see fit , insofar as is compatible with
the use of said tract of land.
THE GRANTEE shall indemnify and hold harmless the Grantor,
its officers and employees from any and all cost , liability
claims on account of injury to or death of any person or persons
whomsoever on account of or connected with the construction of
Landmeier Road.
THE GRANTEE shall restore Grantor' s property to its original
condition upon completion of the Improvement .
This Construction Permit shall terminate Twenty-Four ( 24 )
Months from the date construction is commenced.
IN WITNESS WHEREOF, Grnator has caused this instrument to
be executed on this 24th day of January A.D. 1989 .

DRAINAGE EASEMENT
THIS INDENTURE WITNESSETH: That Grantor, THE VILLAGE OF ELK GROVE VILLAGE,
A Municipal Corporation, organized and existing under the laws of the State
of Illinois, for and in consideration of the sum of TEN DOLLARS ($10.00)
and other good and valuable consideration, receipt of which is hereby acknow-
ledged, paid by and for the Grantee, The County of Cook, a Body Politic,
and Corporate of the State of Illinois, Grantee herein, hereby gives and
grants, but without warranty, subject to the reservations, conditions and
provisions hereinafter contained, unto Grantee a Perpetual Easement for
drainage purposes over, under and across the following tract of land in
the Southwest Quarter of Section 26, Township 41 North, Range 11 East of
the Third Principal Meridian to-wit:

That part of Lot 1 in the Resubdivision of Lots 1 and 2 in Everding Subdivi-
sion of parts of the Southwest Quarter of Section 26, Township 41 North,
Range 11 East of the Third Principal Meridian, bounded and described as follows:
Beginning at the Northeast corner of said Lot 1; thence South along the East
line thereof 30 feet; thence West at right angles to said East line 40 feet;
thence North at right angles to the last described course 30 feet to the
North line of Lot 1 aforesaid (said North line of Lot 1 begin also the North
line of the Southwest Quarter of Section 26 aforesaid) ; thence East along
said North line 40 feet to the place of beginning, in Cook County, Illinois.

11 East of the Third Principal Meridian, falling in a 20 foot strip of land,
the center line of said strip being described as follows:
Commencing at the point of intersection of the center line of Landmeier Road
as now located and occupied, and the West line of the East half of the South-
west Quarter of said Section 26; thence Southeasterly along said center line
of Landmeier Road, a distance of 4.84 feet to a point of beginning; thence
Northwesterly to a point that is 241 .51 feet North of and 7 feet West of the
point of commencement (as measured along said West line and on a line at
right angles thereto) ; thence North along a line that is 7 feet West of and
parallel with said West line (said line having an assumed bearing of N 0°0'
0"W) , a distance of 1289.54 feet; thence N45°0'0"W a distance of 21 .21 feet;
thence West along a line drawn perpendicular to the Westerly right of way
line of Dierking Terrace a distance of 7 feet to said Westerly right of way
line (excepting therefrom that part falling in Landmeier Road) , in Cook
County, Illinois.
ALSO
That part of the Southwest Quarter of Section 26 above described
bounded and described as follows:
Commencing at the point of intersection of the center line of
Landmeier Road as now located and occupied, and the West line
of the East Half of the Southwest Quarter of said Section 26;

a distance of 4.84 feet; thence Northwesterly to a point that
is 241 .51 feet North of and 7 feet West of the point of commence-
ment (as measured along said West line and on a line at right
angles thereto) ; thence North along a line that is 7 feet West

bearing of N 0° 0' 0" W) , a distance of 872.54 feet; thence East
at right angles to the last described course 10 feet to a point
of beginning; thence North at right angles to the last described
course 420 feet; thence East at right angles to the last described
course 14 feet; thence South at right angles to the last described
course 420 feet; thence West at right angles to the last described
course 14 feet to the place of beginning, in Cook County, Illinois.
GRANTOR hereby reserves unto itself, its grantees, licensees, successors
and assigns, the unrestricted right for ingress to and egress from Grantors
adjoining properties and also the right to install, operate, maintain, renew
and remove its or their facilities upon, over and under the surface of said
described tract of land, and to make such other and further use of said
tract of land, as it or they shall see fit, insofar as is compatible with
the use of said tract of land for highway purposes.
GRANTOR also reserves the right without further action to make connections
to the proposed storm sewer for the purpose of draining Dierking Terrace.
THE GRANTEE shall indemnify and hold harmless the Grantor, its officers and
employees from any and all cost, liability claims on account of injury to
or death of any persons or persons whomsoever on account of or connected with
the construction of Landmeier Road.
This Grant is subject to prior rights granted to others by the Village of
Elk Grove Village.
IN WITNESS WHEREOF, Grantor has caused this instrument to be executed
on this 24th day of January A.D. 19 89 .
