Under "THE LOCAL AGENCY AGREES": A. Item (2), (3), (4), (7), (9) and (10) are deleted. B. The following item is added: (12) LA certifies to the best: of its knowledge and belief its officials: (1) are not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from covered transactions by any Federal department or agency; (2) have not within a th:ree-year period preceding this AGREEMENT been convicted of or had a civil judgement rendered against them For commission of fraud or a criminal offense in connection with obtaining, attempting to obtain or performing a public (Federal, State, or local) transaction or contract under a public transaction; violation of Federal or State antitrust statutes or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, or receiving stolen property; (3) are not presently indicted for or otherwise criminally or civilly charged by a governmental entity (Federal, State, local) with commission of any of the offenses enumerated in item (2) of this certification; (4) have not within a three-year period preceding this AGREEMENT had one or more public transactions (Federal, State, local) terminated for cause or default; (5) have not been barred from signing this AGREEMENT as a result of a violation of Sections 33E-3 and 33-4 of the Criminal Code of 1961 (Chapter 38 of the Illinois Revised Statutes); and (6) are not in default on an educational loan as provided in Public Act 85-827.
