A RESOLUTION CALLING FOR A REVISION OF CIRCUIT COURT
FINE DISTRIBUTION
WHEREAS, the Village of Elk Grove Village is a Municipal Corporation
chartered within the State of Illinois, Counties of Cook and DuPage; and
WHEREAS, the public officials of the Village of Elk Grove Village are
responsible to serve in excess of 33,000 population and ensure sound
fiscal management; and
WHEREAS, the Village of Elk Grove Village has been experiencing
dramatic reductions in the amounts of fines collected by the Circuit Court
of Cook County and remitted by the Court; and
WHEREAS, the cause of the reduction is apparently the imposition of
costs and surcharges pursuant to State Statute; and
WHEREAS, the distribution of these monies collected is administered
by the County Clerk; and
WHEREAS, remittance of monies by the County Clerk to the Village of
Elk Grove Village has not been expedited; and
WHEREAS, the money received from court assessed fines is utilized by
communities to offset the costs of traffic and various code enforcement;
and
WHEREAS, the Village is responsible to provide the necessary
personnel and other resources for enforcement purposes; and
WHEREAS, the fines are established on a case by case basis by the
individual circuit court judges; and
WHEREAS, the Presiding Judge of each district can and does
communicate matters of court policy to the individual judges.
NOW, THEREFORE, BE IT RESOLVED, by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage,
State of Illinois, as follows:
Section 1. That the Village of Elk Grove Village does hereby call
upon the Presiding Judge of the Third Municipal District of the Circuit
Court of Cook County to review with his respective colleagues the general
amounts being levied as fines for various offenses in view of the
increased costs which are being deducted prior to payment to the
municipality.

Section 2., That the Village of Elk Grove Village does hereby call
upon the judges after making such a review to adjust their schedules of
fines accordingly.
Section 3. That a copy of this Resolution be forwarded to the Chief
Judge of the Circuit Court of Cook County, the Presiding Judge of the
Third Municipal District Court, and to the Northwest Municipal Conference.
Section 4. That this Resolution shall be in full force and effect
from and after its passage and approval according to law.
