HomeMy WebLinkAboutRESOLUTION - 19-87 - 3/24/1987 - NWMC REVIEW OF COMED FRANCHISERESOLUTION NO. 19-87 A RESOLUTION ADVISING COMMONWEALTH EDISON THAT THE NORTHWEST MUNICIPAL CONFERENCE MEMBERS WILL BE REVIEWING THE FRANCHISE SITUATION AND SEEKING THEIR ASSISTANCE ON FORMING WORKABLE GUIDELINES WHEREAS, the Northwest Municipal Conference is a corporate organization representative of municipalities and townships chartered within the State of Illinois and the County of Cook; and WHEREAS, Article VII, Section 10, of the Constitution of the State of Illinois, and Chapter 127, paragraphs 741 through 748 of the Illinois Revised Statutes, authorize and encourage intergovernmental association and cooperation; and WHEREAS, the public officials of the Northwest Municipal Conference represent thirty-eight local governmental bodies (including the Chicago Area Transportation Study (CATS) Northwest Region) and a population of over 980,000 Illinois residents; and WHEREAS, the Commonwealth Edison Company has current franchise agreement expiring between 1991 and 2030 with the member municipalities of the Northwest Municipal Conference; and WHEREAS, it is in the mutual interest of both the Commonwealth Edison Company and municipalities to continue to enter into franchise agreement; and WHEREAS, a sub -committee of the Northwest Municipal Intergovernmental Committee is reviewing the terms of current franchise agreements with member municipalities; and WHEREAS, said committee is collecting research on options available in securing energy; and WHEREAS, said committee is reviewing franchise terms including compensation, burial of cable, favored nation clause, signal and street light energy, length of agreement, non-exclusive contract, maintenance, and easement administration; and WHEREAS, said committee will upon completion of its works file a written report and recommendations for consideration by the membership; and WHEREAS, Commonwealth Edison will be approached by Northwest Municipal Conference Commonwealth Edison committee to seek their assistance in formulating workable guidelines and models; and WHEREAS, the Northwest Municipal Conference membership supports the efforts of the Commonwealth Edison sub -committee in investigation and reporting on this issue. NOW, THEREFORE, BE IT RESOLVED, by the President and Board of Trustees of the Village of Elk Grove Village, Cook and DuPage Counties, Illinois as follows: Section 1. That the membership of the Northwest Municipal Conference advise the Commonwealth Edison Company that a sub -committee of the Northwest Municipal Conference has formed to investigate and report on franchise agreement issues between member municipalities and Commonwealth Edison and that Commonwealth Edison's cooperation and assistance with this committee's work is requested. Section 2. That the member municipalities of the Northwest Municipal Conference will refrain from individual negotiations with Commonwealth Edison until such time as the Commonwealth Edison sub -committee has prepared a report and recommendation for consideration by the membership. Such report to be filed no later than April 1, 1988. Section 3. That the Village Clerk is hereby directed to forward a certified copy of this Resolution to Commonwealth Edison Company. Section 4. That this Resolution shall be in full force and effect from and after its passage and approval according to law.
