HomeMy WebLinkAboutRESOLUTION - 43-87 - 7/14/1987 - GRANT OF EASEMENT/GULLORESOLUTION NO. 43-87 A RESOLUTION AUTHORIZING THE PRESIDENT AND CLERK TO EXECUTE A GRANT OF EASEMENT BETWEEN THE AMERICAN NATIONAL BANK OF ARLINGTON HEIGHTS AND THE VILLAGE OF ELK GROVE VILLAGE (GULLO) NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois: Section l: That the Village President be and is hereby authorized to sign the attached documents marked: EASEMENT GRANT a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. Smith Village Clerk EASEMENT GRANT This easement grant is made between the Village of Elk Grove, Illinois, hereinafter referred to as "Grantor", and American National Bank of Arlington Heights as trustee under trust agreement dated September 9, 1980, and known as trust no. A-1283, hereinafter referred to as "Grantee". The Grantor is the owner of a tract of land described as follows and hereinafter referred to as Parcel 1. A parcel of land 30 feet wide and 219 feet long immediately south of and adjacent to Lot 197 in Higgins Industrial Park Unit 138 being a sub- division of the northeast quarter of Section 27, Township 41 North, Range 11 east of the Third Principal Meridian in Cook County, Illinois. The Grantee is the owner of a tract of land described as follows and hereinafter referred to as Parcel 2. Lot 197 in Higgins Industrial Park Unit 138 being a subdivision of the northeast quarter of Section 27, Township 41 North, Range 11 east of the Third Principal Meridian in Cook County, Illinois. The Grantor wishes to grant and the Grantee wishes to receive an easement over Parcel 1, hereinafter referred to as the "Easement Premises", for parking of motor vehicles. Parcel 1 is presently an open drainage ditch used to carry surface water and Parcel 2 will be improved with an industrial type building. Now, therefore, in consideration of the installation of a 54 inch concrete pipe for the full length of 219 feet to be constructed as per attached civil engineering drawings of Norman J. Toberman Associates by the Grantee's bene- ficiary, the following grants, agreements, covenants and restrictions are made: A. The Grantor hereby grants to the Grantee, their assigns and successors, an easement appurtenant to Parcel 2 as a perpetual easement for the parking of motor vehicles upon the easement premises. B. After the installation and the original construction by the beneficiaries of the Grantee, all subsequent main- tenance and replacement of the concrete pipe shall be per- formed by the Grantor. C. The Grantee hereby covenants and agrees to promptly improve the easement premises with an asphalt surface suit- able for parking of motor vehicles and will at all time maintain the surface in good repair. All of the provisions of this instrument, including the benefits and burdens, run with the land and are binding upon and endured to the assigns and successors of the parties hereto. All notices to the Grantor shall be at 901 Wellington Avenue, Elk Grove Village, Illinois 60007. All notices to the Grantee shall be at 33 N.
