ARLINGTON HEIGHTS ROAD (WINGSPAN DEVELOPMENT GROUP) WHEREAS, The Plan Commission of the Village, at a public hearing duly called and held according to law, considered the question of rezoning, granting a Special Use Permit for a Planned Development and approving a plat of resubdivision for property located at the southeast corner of Higgins Road and S. Arlington Heights Road and legally described on Exhibit A, attached hereto; and WHEREAS, The Mayor and Board of Trustees of the Village, after having reviewed the recommendation of the Plan Commission, find and believe it to be in the best interests of the Village to grant the request for rezoning and the Special Use Permit and to approve the plat of subdivision; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there is hereby approved a Plat of Resubdivision identified as the Elk Grove Woods Subdivision, a copy of which is attached as Exhibit B, attached hereto. Section 2: That the property, as Resubdivided, be and the same is hereby rezoned from the B-3 to the B-1 zoned district for the commercial property on Lot 1 and to A-2 Multiple Family Residence District for the residential property on Lot 2. Section 3: That there is hereby granted a Special Use Permit for a Planned Development in accordance with the Elk Woods Plaza Planned Development Regulations attached hereto as Exhibit C. form. Section 4: That the Village Clerk is authorized to publish this Ordinance in pamphlet Section 5: That this ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form according to law. These parcels were zoned as B-1 Business District and B-3 Automotive Business District. The property will be a mixed -use development with an underlying B-1 Business District and A-2 Multi family Residential Zoning District consisting of two lots. The north lot will be retail use consisting of two (2) commercial multi -tenant buildings. The south lot will be a mixed residential and retail use consisting of a five (5) story mixed use luxury apartment building with amenities and first floor retail along with two (2) eight (8) unit apartment type three (3) story row homes. 11. Design and Development Objectives The intent of the design and development regulations are to: A. Create a high -quality residential and retail environment to attract and retain retail partners in an aesthetically enhanced environment and B. Distinguish and promote the area based upon the proximity to Busse Woods- Forest Preserve District and establish the corridor as a prominent gateway into the Village of Elk Grove Village. lll. Planned Development Requirements The site will be required to include elements as depicted in Exhibit B —Site Plan and Exhibit C— Plat of Subdivision along with the following: A. North Lot- Three point four (3.4) acres (147,792 S.F.) South Lot- Six point seven (6.7) acres (292,660 S.F). B. Zoning - B-1 Business District and A-2 Multifamily Residential C. Permitted Uses— Uses permitted in B-1 Business Districts and A-2 Multi family except prohibiting: 1. Medical uses in excess often (10%) percent of the total retail square footage available on the property; Smoke/vape shops; Il. Gas stations, lll. Automotive retail; IV. Pawn shops; V. Tattoo shops; Vl. Hotels; Vll. Currency exchange; and Vlll. Stand-alone financial institutions. D. Bulk requirements I. General Site Requirements Requirements as depicted in Exhibit B — Site Plan along with the following: I. Major portion of exterior walls are required to be brick or masonry as depicted in Exhibit D —Elevations, elements such as architectural trim, accents, etc. are permitted to be of a different material. II. Public sidewalk along E. Higgins Road and S. Arlington Heights Road shall be constructed of concrete with a width of ten (10) feet and eight (8') feet respectively; lll. All interior sidewalks shall concrete or brick pavers with a width of five (5') feet, except service walks to individual townhome units, which may be a width of four (4') feet, IV. Outdoor seating areas and exterior service areas are subject to Zoning Administrator review and must maintain minimum accessibility standards; V. Exterior mechanical ventilation equipment, not installed on the roof, must be screened and/or and integrated into the overall building design as approved by the Zoning Administrator; Vl. All utilities are required to be installed underground, Vll. All utility appurtenances including telephone pedestals, utility meters, transformers, etc. shall be screened. All such appurtenances shall be painted to match the primary building color or shall be painted black in color when not adjacent to buildings, Vlll. Garbage Corral Provisions: 1. Building Cs garbage corral is required to be screened with brick enclosure(s) matching the primary building fagade with metal self -closing gates and 2. Other garbage areas are required to be located on the interior and must be constructed of masonry with metal self -closing gates. IX. Storm water management practices must be provided underground. F. Screening Screening shall be provided as depicted in Exhibit D — Elevations along with the following: I. An eight (8') foot high screen wall shall be installed along the east and south property lines abutting the single-family residential areas. 1. The wall shall be a similar or equivalent product to RhinoRock European Castle (rhinorock.com) style fence design. ll. Roof top equipment shall be centralized and screened from view with material which architecturally compliments the principal building design. 111. Pool fencing must be six (6') foot ornamental. G. Site Lighting I. A maximum height of twenty (20') feet; ll. Black in color, lll. All light sources must have a correlated color temperature of 3,000 degrees Kelvin or less, IV. Free standing lighting located on the perimeter of the parking lot shall face the building and be provided with shields/deflectors which direct all lighting onto the property; V. Lighting mounted on the building exterior walls shall be completely shielded to eliminate glare or visibility of the light source from the adjacent properties; and VI. A minimum of one half (0.5) foot candle of light must be provided at all parking and drive aisles. No more than point one T(0.1) foot candle of light shall extend beyond the East and South lot lines. H. Site Landscaping Boundary, parking lot, and site landscaping is required as depicted in Exhibit E — Landscape Plan: A strip of grass not less than three feet (3') wide shall be maintained between the public sidewalk and the boundary landscaping so that this area can be regularly mowed and maintained. Parking Requirements Parking layout and quantities must meet the requirements as depicted in Exhibit B — Site Plan along with the following: I. Townhomes must have a 60AI240V garage circuit and junction box made ready for EV charging station(s) in garage, ll. Two (2%) percent of surface level parking spaces are required to have EV charging stations; One (1) is required to be adjacent to handicap accessible parking; lll. Five (5%) percent of parking garage spaces are required to have EV charging stations; One (1) is required to be adjacent to handicap accessible parking; IV. Twenty-four (24') foot two-way drive aisles; V. Nine (9') foot x nineteen (19') foot surface parking spaces; VI. Parking Garage 1. Eight foot six-inch (8'-6") x eighteen foot six-inch (18'-6") designated residential unit parking spaces and 2. Nine (9') foot x nineteen (19') foot first floor level parking spaces. Vll. Curbed parking lot islands throughout the development. J. Sign requirements. Site signage must meet the requirements of Exhibit F—Sign Plan along with the following: I. General requirements 1. All signs shall be in accordance with the regulations of Title 8, Chapter 3: Building Activity Code of the Village Code and this section whichever is most restrictive, 2. Signs shall be generally centered over the tenant space storefront or as approved by the Zoning Administrator, 3. Sign(s) which are replaced are required to have mounts, fagade damage, discoloration, and nonconformity to adjacent areo(s) restored prior to the installation of new sign(s); 4. No exposed raceways, crossovers or conduits will be permitted; and 5. Upon review of a sign application, the Zoning Administrator will make a recommendation to the Mayor and Board of Trustees for review and approval. ll. Retail Informational Monument Signs and Residential Monument Signs shall meet the standards presented on sheet 4.7 of Studio 222 Architects plan dated 1011112023 as specified in Exhibit F. Ill. Wall Signs 1. Maximum size of three (3) square feet per each linear foot of frontage. 2. Only channel letter signs and dimensional surface signs are permitted. 3. Sign Lighting a. Lighting to be provided by approved building lighting, internally lit, or by external Gooseneck down lighting as approved by the Zoning Administrator. b. All external lighting of signs shall be directed only at the sign face and shall be shielded so that the light source is not visible from the property line or directly cast light or glare on any right-of-way or adjacent property. IV. Canopies, Marquees, Cloud Signs, and Awning Signs 1. Awnings throughout the development shall be a compatible color as to what is specified in Exhibit F. The Zoning Administrator will make a recommendation to the Mayor and Board of Trustees for review and approval. 2. Maximum percent of area, No sign identifying an individual tenant of a multi -tenant building shall cover more than fifty percent (50%) of the awning, or canopy to which it is affixed. 3. Maximum square footage; Not to exceed fifteen (15 )square feet per sign face. 4. Maximum height; Twenty (20) feet above grade; and not higher than the awning or canopy to which it is affixed. 5. Maximum number per tenant, One (1) per awning, canopy, or entrance identifying a tenant space having its own exterior customer entrance. V. Window Signs 1. A permit is required for window signs in excess of twenty-five (25) square feet; 2. Sign area shall not exceed fifty (50%) percent of the window area; and 3. Maximum sign area is one and one half (1 %) square feet per linear foot of building frontage on a road. Vl. Temporary A -Frame Signs 1. A frame signs may be located on a private sidewalk not located within the public right-of-way, as long as at least four (4') feet of sidewalk width remains so as to not interfere with pedestrian accessibility. A frame signs must be located within ten (10') feet of the primary entrance of the business for which the sign references or advertises; 2. One A frame sign is allowed per business; 3. A frame signs shall not exceed eight (8) square feet in area or four (4') feet in height; and 4. A frame signs may be displayed on a daily basis, but the display shall be limited to business hours. A frame signs must be stored indoors at all other times. Vll. Prohibited Signs: The following signs are prohibited: 1. Electronic Message Signs; 2. Animated signs or signs supported by manufactured air pressure; 3. Attention getting devices, including but not limited to searchlights, pennants, propellers, spinners, streamers, balloons, and similar devices; 4. Billboards; 5. Feather signs, 6. Flashing signs and devices; 7. Signs lit by any revolving or rotating beams or beacons, 8. Moving signs except barber poles, flags, street clocks, and other signs as specifically permitted in the Elk Grove Village Code. 9. Off premises signs, 10. Painted wall signs, 11. Pole signs; 12. Portable signs; 13. Roof signs, 14. Vehicle signs, and 15. Other signs as may be prohibited in the Elk Grove Village Code. K. Bicycle Parking 1. One (1) bicycle space for every twenty-five (25) vehicle parking spaces, ll. Bicycle parking shall be located near the building entry points, shall not conflict with pedestrian travel, and is not allowed to be located in a parking lot; and lll. Bicycle parking shall be provided using bicycle racks or locker type storage.
