Zoning Variation — Docket #24-1, 400 Bianco Drive
Chairman Childress called the meeting to order at 7:00 p.m. and read a statement describing the hearing
notification procedure as well as the legal notice.
The petitioners, Scott and Katie Beardsley (Owners of Record) were sworn in and asked to state their
case for requesting a zoning variation.
The petitioners stated they wanted to install a new wood fence to finish enclosing their yard to provide
added privacy and future pets. If the fence were to be installed where the code allows, it would place it
in a location that would require a portion of their deck to be removed and their sliding door rendered
inoperable.
Chairman Childress opened the meeting to questions from the board.
Members Bookler inquired if the petitioners had spoken to their neighbors regarding the location of the
fence.
The petitioners stated they have not.
Member Glimco inquired about the type of fence that was proposed.
The petitioners stated it would be a wood fence.
Members Serrano and Fowler had no questions.
Chairman Childress stated that the proposed fence would not create any sight line issues. Chairman
Childress stated that no utilities or drainage issues appear to conflict with the proposed fence
placement.
Community Development staff had received a letter from the adjacent neighbor, Jacek and Janina Pron
at 833 Crest Avenue. They stated in the letter that they had an objection to the variation request.
The Community Development Department stated they had no other phone calls or emails and had no
objection to the variation request.
Chairman Childress read the letter into public record. The Pron's have been in their home since 2006
and object to their view from the windows on the south side of home being blocked by the proposed
fence alignment to the west as proposed.
Chairman Childress asked if there were any additional comments or questions from the Board or
members of the audience.
Gerald Borek, resident at (848 Crest Avenue) attended the meeting and spoke that he was in support of
the proposed fence variation and noted that it afforded the petitioners privacy and would contain any
family pets.
Members Serrano, Bookler, Glimco and Fowler had no other questions.
Chairman Childress called for the motion.
A Motion to DO GRANT a variation to permit the installation of a six (6') foot high fence which will
extend approximately fifteen (15') feet beyond the nearest front corner of the principal structure on the
adjacent single-family residential lot to the north at 833 Crest Avenue was made by Member Glimco and
seconded by Member Serrano.
Upon voting (AYES — Bookler, Childress, Fowler, Glimco and Serrano) (NAYES- None.)
(ABSENT — Latrofa, Rawleigh, Romanski and Spragg)
The motion carried.
Chairman Childress advised the petitioners to contact the Village Clerk and be available for the
subsequent Village Board Meeting on March 26, 2024.
Chairman Childress called for a motion to adjourn.
This Motion to adjourn was made by Member Glimco which was seconded by Member Serrano.
The motion carried.
The meeting adjourned at 7:22 p.m.

Dear Honorable Mayor and Board of Trustees:
On March 14, 2024, at 7:00 p.m., Zoning Board of Appeals Chairman, Donald Childress called the
hearing to order. The petition was read. Petitioners Scott and Katie Beardsley (Owners of Record) were
sworn in and asked to state their case for requesting a zoning variation.
Section 3-3-B: (2) prohibits fences from being constructed within the required front yard and beyond a
line extended from the nearest front corner of the principal building located on an adjacent single-family
residential lot. The petitioners are requesting to install a six (6') foot high fence which will extend
approximately fifteen (15') feet beyond the nearest front corner of the principal structure on the
adjacent single-family residential lot to the north at 833 Crest Avenue.
The following questions and comments were brought up by the Members:
1. The petitioner's hardship is that they want to install a new wood fence to finish enclosing
their yard for added privacy and future pets. To install the fence in an approvable location, it
would place it in a location that would require a portion of their deck to be removed and
their sliding door rendered inoperable.
2. Member Bookler asked the petitioners if they had spoken to their neighbors regarding the
placement of the fence. The petitioner responded that they had not discussed the variance
request with their neighbors.
3. Chairman Childress stated that there would be no sight line issues with the proposed fence.

This was made by Member Glimco and seconded by Member Serrano.

Vote to DO NOT GRANT: None
ABSENT— Latrofa, Rawleigh, Romanski and Spragg
The meeting adjourned at 7:22 p.m.
