HomeMy WebLinkAboutRESOLUTION - 81-85 - 10/8/1985 - FAIR LABOR STANDARDS ACT RESOLUTION NO. 81-85 A RESOLUTION OPPOSING LOCAL GOVERNMENT COVERAGE UNDER THE FAIR LABOR STANDARDS ACT WHEREAS, the Village of Elk Grove Village has always maintained the position that amicable employee relations is indispensible to the delivery of public services; and WHEREAS , the Village of Elk Grove Village views the decision by the United States Supreme Court in the case of Garcia V San Antonio as inserting the Federal Government into the arena of local employee relations; and WHEREAS, the Village of Elk Grove Village also views with alarm the apparent disregard of the Tenth Amendment to the Constitution of the United States by the Supreme Court in the Garcia Decision; and WHEREAS, the only recourse that local governments have with regard to this costly and administratively burdensome decision is to seek redress by the Congress of the United States. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Cook and DuPage Counties, Illinois: Section 1 . That the Village of Elk Grove Village call upon Senators Alan Dixon and Paul Simon and Representative Henry Hyde to support amendatory legislation to the Fair Labor Standards Act that: a. Exempts individuals who provide service to state and local governments on a volunteer basis from the wage and hour provisions. b. Exempts all state and local employees from the overtime provisions which effectively preclude the option of compensatory time off. c. Eliminate retroactivity under the law for the period prior to the Department of Labor enforcement date of October 15, 1985. Section 2. The Village Clerk is hereby authorized to forward copies of this Resolution to Senators Dixon and Simon and Representative Henry Hyde, the Northwest Municipal Conference, the Illinois Municipal League, the National League of Cities and the National Association of Towns and Townships. Section 3. That this Resolution shall be in full force and effect from and after its passage and approval according to law. PASSED this 8th day of October , 1985.
