AN ORDINANCE PURSUANT TO THE VILLAGE'S HOME RULE AUTHORITY TO
ALLOW FOR LATERAL TRANSFER POLICE OFFICER HIRING BY THE FIRE AND
POLICE COMMISSION
WHEREAS, the Village of Elk Grove Village hires police officers through its Board of
Fire and Police Commissioners pursuant to Chapter 7 of Title 2 of the Village Code; and
WHEREAS, the Village is a home rule unit pursuant to Section 6 of Article VII of the
Constitution of the State of Illinois and, as such, has the authority to modify the provisions of the
Illinois Municipal Code with respect to its hiring of police officers; and
WHEREAS, the Village Board of Trustees has determined that it is in the best interests of
the Village and its citizens to allow the Board of Fire and Police Commissioners to create a process
for the lateral hiring of existing certified sworn police officers from other police departments to
supplement, and be in addition to, the register of eligibles, as defined in 65 ILCS 5/10-2.1-14;
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1:
1. The Village of Elk Grove Village Board of Fire and Police Commissioners shall have
the authority to establish rules for the hire of "lateral transfer applicants" (as defined below)
without regard to the register of eligibles maintained for police officer applicants, and further shall
have the authority to exempt lateral transfer applicants from any testing requirements for original
appointments under its rules and regulations.
"Lateral Transfer Applicant" shall mean an applicant who has been certified by the Illinois
Law Enforcement Training and Standards Board.
Section 2: This Ordinance shall be in full force and effect from and after its passage and
approval according to law.
