ELK GROVE VILLAGE, ILLINOIS (MATERIAL SERVICE CORPORATION) WHEREAS, the Zoning Board of Appeals, at a Public Hearing duly called and held according to law, considered the question of granting a variation of Section 3-70.1 and Section 3-70.5 of the Zoning Ordinance pertaining to overhanging structures to permit the installation of a canopy that would encroach approximately 6 feet (6') into the required twenty-five foot (25') front yard on property located at 2300 Pratt Blvd, Elk Grove Village; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having considered the recommendation and finding of said Zoning Board of Appeals, find and believe that sufficient hardship exists so as to justify the granting of said variation. The petitioner is asking for a variation from the provisions of the Elk Grove Village Zoning Ordinance No. 2410, as it pertains to the front yard setback requirements for structures. Section 3-7:1).1 states that no principal structure and no attached accessory structure shall be located in any required front yard area. Section 3-7:13.5 permits the projection of an overhang not to exceed twelve (12") inches. The petitioner is seeking a variation which would permit the construction of a canopy to cover an exterior stairway leading to the lower level of the building that would encroach approximately six (6') feet into the required twenty five foot front yard, given the allowable twelve inch overhang. The net request is for a five (5) foot variation. The petitioner had indicated that the purpose of requesting this hearing was for the safety of their employees. This exit is for the purpose of exiting the basement area during an emergency. The installation of the canopy will help minimize the snow, rain and debris from trees from gathering on the stairs and at the bottom of the basement stairway. The commissioners asked questions and made comments: Canopy installation will be supported by existing foundation for stairway. 2. Canopy is needed for safety of ingress and egress for OSHA requirements and fire service access. 3. The variation requested is necessary for safety of removing employees to the outside in an emergency. 4. Existing landscape will mostly hide the canopy. 5. New roof structure over stairs will blend with existing building. 6. Lower level is limited use for training employees. Only about 24 employees at a time will be in the lower level. There was no public comment. The chairman called for a motion. Mr. Larry Dohrer made a motion to DO GRANT the variation. Mr. Don Childress seconded the motion. DOMARACKI: I've got a couple handouts, I don't know if -- that give you some pictures, give you some idea what we're looking at here. MR. KAPLAN: Sure. MR. DOMARACKI: How do I get them to you? MR. ZINNEL: I will go get it. MR. DOMARACKI: Thank you. MR. ZINNEL: You bet. MR. DOMARACKI: We're looking for this, the variance for the stairway that's exiting the lower level of our office building. This is an area that's used -- we haven't used it in the past ten years. We have another location that's at 2200 East Pratt, but we're probably going to be moving a group of people over to the 2300 building, and in the 2300 building, the lower level is where we do a lot of training. It's our largest area where we can gather the employees so that we can do some training. Training is required by OSHA and whoever else. And in that area, there is an entrance from GINA NUNES, C.S.R. But there is also an exit that's in a recessed area that you can see on the handout, concrete stairs, goes down probably 10, 12 feet, and that's the emergency exit. And our safety committee has a little concern. We've had some problems there. There is an outside drain, the drain plugs. We have to keep it clean, you know. We've been doing probably a better job keeping it clean. But snows, the snow we had this year wouldn't be as good of an example because that's an exceptional snow. But any time you get a lot of blowing snow, the snow builds up in there, and the problem is that we can be there in the morning cleaning it up, we get a decent snow, you know, it is difficult to open the door to get out, okay. And so there is a concern about having, you know, 30 people down there and their ability to get out of the building if there is some kind of an alarm. And that's the primary reason for, you know. Initially we were looking for an enclosure. We understand we can't get an enclosure so the canopy is a means to keep leaves, dirt, debris, you know, and the rain, you know, out of the stairwell area GINA NUNES, C.S.R. Before I open it to questions to the Commissioners, I want to come back again. You stated that the building hasn't been used in ten years, you haven't used that lower level? MR. DOMARACKI: We haven't really used the lower level, no. The building has been used. MR. KAPLAN: The building has been used but the lower level has not. MR. DOMARACKI: Not really, no. MR. KAPLAN: Is that lower level as large as the building or just a small area? MR. DOMARACKI: There is 8000 square feet on a given floor. That's around 4000, 5000 square feet. MR. KAPLAN: Okay. And how many employees are usually down there at one time when you're doing training? MR. DOMARACKI: Never counted. We probably got on MR. KAPLAN: Okay. Okay. I will open to questions. Don. MR. DOMARACKI: Well, the shrubs, you know, we've got to decide what we are going to do there because there is a large white pine that you will see in the picture that we're pretty partial to but it's kind of -- and there is evergreens that are in front but the evergreens are in need of a little sunlight and so we've got to -- right now we're not looking to take out the evergreens that are there, but in the future, we might, and we're still going to put something back. We like the fact that it's, you know, it is hidden there. MR. CHILDRESS: So you may end up relocating, the net effect may be relocating some major greenery outside of the canopy? MR. DOMARACKI: I don't think that -- the canopy is going to go in as it is right now, okay. I guess what I'm saying is that the, you know, once we started taking a closer look at things, we seen that some of the evergreens aren't in the best of shape so we, you know, with us moving a larger group of people over there, we're going to look at GINA NUNES, C.S.R. You know, so the point is we wouldn't take it down because we're putting the canopy up. If we take it down, we're putting something else back in that will be able to -- that will grow in that shaded area. MR. CHILDRESS: Right. And then with the enclosure where it's planned, the canopy foundation, will it, I guess, go outside the existing? MR. DOMARACKI: No. The foundation is there. The foundation is the stairwell that's going down. MR. CHILDRESS: So you are just going to attach to that? MR. DOMARACKI: Right. We're just going to the top of that. We're not extending past the foundation, okay. I mean the -- I shouldn't say that. The drip is going to come down, you know, six or so inches past the foundation so it is not dripping on the foundation. MR. CHILDRESS: Right. DOMARACKI: No, no. MR. CHILDRESS: I don't have any further questions. MR. KAPLAN: Okay. Dion. MR. ZINNEL: Is it going to be fabricated out of metal canaopy or wood shingles? MR. DOMARACKI: No. In the picture you will see this is a metal panel and glass building, and the idea is to use the same type of sandwich panels. That building was done in the '60s, okay. And so it has embossed panels on it. So what happens to a building that's painted and it has embossed panels is that the tips wear down. So the panels we'll put in will probably look a little brighter but the idea in the future will be to paint that exterior so things match. MR. ZINNEL: That's all I have. MR. KAPLAN: Joe. MR. OLIVETO: That stairway been there as long as the building? MR. DOMARACKI: Yes, it has. MR. OLIVETO: And just how deep is the canopy about, six feet or -- MR. DOMARACKI: The canopy is going to be, it GINA NUNES, C.S.R. You know, if you were able to look, there is a sketch in there, I believe it shows we're going to one of the frames for the -- you can see, you got the glass and then you got the white panels. This is going to be right above the glass. That's where it is going to start, okay? MR. OLIVETO: I don't have anything else. MR. KAPLAN: Scott. MR. CARLSON: Actually all my questions have been answered. MR. KAPLAN: Larry. MR. DOHRER: No real questions. I think it is a good idea. It is an existing stair and the setback so it is already there so even though you need the variation, it's already there, so I have no problem with that. It's a basement. You need a second exit out of the basement anyway so that's a good point, so to cover it is good because there is a position in the code that takes on that you have to cover exterior staircases anyway, so it is GINA NUNES, C.S.R. DOMARACKI: You're right. MR. DOHRER: I see nothing on there that I would object to. MR. KAPLAN: Anything in engineering at all? MR. TRUDAN: No. MR. KAPLAN: Any concerns or anything? MR. The location, size and use of all existing buildings and structures. The facility location is 2300 east Pratt Blvd in Elk Grove Village. The property is approximately 11.7 acres. The building square footage is 205,176. The facility houses (2) continuous operating metal coating lines, slitting and packaging line and an inspection line. The facility warehouses raw and finished metal coils, adhesives and paints. The facility treats its own process waste. The facility also has approximately 30,000 square feet of office space that is or will be used for plant and corporate personnel. 2. The proposed use of the property. The facility is used to operate the process lines that provide specialty coated and laminated products for automotive, appliance and other industries. The area in consideration is an outside exit stairway used for egress from the building basement area in the event of an emergency. This secondary exit from the basement is required by code. The finished basement contains a conference or meeting room, a restroom, a small lunch room, a storage room, and a mechanical room. The conference room is also used as a tornado shelter. During inclement weather, wet leaves, snow, and ice accumulate on the concrete stairs and at the bottom of the stairwell. This compromises safety of MSC's employees in the event that the emergency exit must be used. It is MSC's opinion that this exit should be kept clean and dry at all times to best insure the safety of its employees. This is best accomplished with a cover over the entire stairwell. The proposed cover would be supplied and installed by a company that specializes in various types of sunroom enclosures. The solarium -type cover is designed to match the existing white siding and bronze trim of the building. The enclosure would be constructed of 3" thick white insulated wall and roof panels, single pane tempered window and transom glass, bronze extruded aluminum frame members, bronze gutter/fascia, and a commercial grade out -swing door with panic hardware. The amendment is to replace the basement stairwell enclosure requested in the original variance with a canopy, which eliminates the walls and door from the enclosure. There are (2) exits for the basement area and one exit goes directly outside. The MSC employee's safety committee has a concern that the basement emergency exit, which exits directly outside, is not adequately protected and creates additional safety issues. The stairwell safety issues concern water ponding at the lower level, and snow, ice and debris blocking the outside of the exit door and accumulating on the stairs. The purpose for the canopy is to minimize the snow, rain and debris from trees from gathering on the stairs and at the bottom of the basement stairwell. MSC has replaced drain tile to eliminate water collecting at the bottom of the stairwell, and provides a daily inspection and cleaning of the area, but there are times when that exit still has a problem. The most recent was the large snow fall in January that dropped a significant amount of snow in the stairwell making the exit unusable for a period of time. When the facility is operating 24 hours a day there can be times when there can be an accumulation of snow, or debris in the stairwell between inspections. The canopy will not eliminate all the problems, but will help in keeping the stairwell free from debris and elements falling down from overhead. MSC will continue the daily inspection and cleaning as needed to minimize any safety issues. MSC would appreciate your consideration in the resolution of this issue. As a comment to your concern about the appearance of the canopy, MSC intends to use materials that closely match the exterior white panel on the building. MSC is also considering plans to remodel the 2300 building offices in the future. The exterior office appearance is part of the review for the upgrade and may include the replacement of the metal panels or painting.
