Polony, Plan Reviewer, Community Development Zoning Variation — Docket # 11-2 638 Stonehaven Ave. Chairman Kaplan called the meeting to order at 7:00 pm and read a statement describing the hearing notification procedure as well as the legal notice. The petitioner, Susan H. Wood, was sworn in and asked to present her case. Ms. Wood stated she would like to replace her existing six foot (6') high, stockade fence with a new six foot (6') high, privacy fence in the exact same location. She mentioned a six foot (6') high fence would provide more safety and security due to a pool within her backyard. She stated concerns that a four foot (4') high fence would be more susceptible to outsiders possibly jumping over the fence and getting into the pool/backyard. Mr. Kaplan opened the meeting to questions from the board. Mr. Carlson asked the petitioner what kind of fence would be installed. Ms. Wood indicated she was looking into a privacy style fence. She mentioned at this time she was researching multiple styles of fence and had not come to a final decision on the style as of yet. Mr. Dohrer asked the petitioner how long the fence has been in place. Ms. Wood stated the fence has been in place for approximately twenty five (25) through thirty (30) years. Mr. Dohrer asked the petitioner to state her hardship for the variance request. t Ms. Wood stated she was concerned with the safety and protection of her backyard. She stated a six foot (6') fence in this location would reinforcement protection of her backyard. Mr. Bookler asked the petitioner if the fence would be vinyl. Ms. Wood reiterated she had not come to a final decision on the style of fence; however she would like a fence style which required low maintenance. A motion to grant a variation for the installation of a six foot (6') high fence extending approximately four feet (4') into the ten foot (10') clearance required from the street side property line between the front edge of the house and the rear edge of the house was made by Mr. Dohrer and seconded by Mr. Carlson. Upon voting (AYES -Kaplan, Bookler, Meister, and Colgan) the motion to grant the variance passed unanimously. Mr. Kaplan advised the petitioner, Ms.Wood, to contact the Village Clerk and attend the subsequent Village Board Meeting. The petitioner had indicated that the purpose of requesting this hearing was for safety reasons. The old fence was deteriorated and a new fence needs to be installed for safety since there is an existing swimming pool in her backyard. The Commissioners asked questions and made comments: 1. The existing fence was in place for over 30 years. New fence will be installed in the same location as existing. 2. No sight line problems with the new fence. 3. Hardship shown was for safety. 4. Engineering had no issues. There was no public comment. The Chairman called for a motion. Mr. Larry Dohrer made a motion to DO GRANT the variation. Mr. Scott Carlson seconded the motion.
