A RESOLUTION AUTHORIZING THE VILLAGE MANAGER AND VILLAGE
CLERK TO EXECUTE A HIGHWAY AUTHORITY AGREEMENT BETWEEN THE
VILLAGE OF ELK GROVE VILLAGE AND ILLINOIS DEPARTMENT OF
TRANSPORTATION (IDOT)
WHEREAS, Elk Grove Village (Village) acquired the former Shell Service Station at 1 E.
Higgins Road as part and parcel of a property assemblage for the new Wingspan Development
Project on (9-29-22); and
WHEREAS, Village removed petroleum underground storage tanks and performed soil
and groundwater remediation on the property after acquisition, but at no time contributed to
petroleum releases on the property. Such remediation was impractical and infeasible for potential
petroleum releases that may be present under Higgins Road having IDOT jurisdiction; AND
WHEREAS, the Village has conducted environmental remediation work and is requesting
a "No Further Action" letter from Illinois EPA (IEPA) for the property to facilitate transfer of the
property to a developer; and
WHEREAS, IEPA requires that the Village obtain a Highway Authority Agreement with
IDOT as a recorded institutional control that alerts future roadway construction workers of the
potential presence of petroleum compounds in groundwater beneath the right of way of Higgins
Road; and
WHEREAS, IDOT has agreed to provide a HAA with the Village in identical form of its
standard language as the sample copy attached. IDOT has requested a Village Board resolution
authorizing the Village Manager to sign the HAA on behalf of Elk Grove Village.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows:
Section 1: That the Village Manager be and is hereby authorized to sign a Highway
Authority Agreement between the Village of Elk Grove Village and Illinois Department of
Transportation (IDOT), the form of which Agreement is attached hereto.
Section 2: That this Resolution shall be in full force and effect from and after its passage
and approval according to law.
