HomeMy WebLinkAboutRESOLUTION - 92-85 - 11/12/1985 - STATEMENT OF COMMITMENT/SIDEWALK RESOLUTION NO. 92-85 A RESOLUTION APPROVING A STATEMENT OF COMMITMENT TO INSTALL PUBLIC SIDEWALKS BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND SIXPENCE INN - PHASE II NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois: Section 1 : That the Village of Elk Grove Village does hereby accept the attached document marked: "Statement of Commitment to Install Public Sidewalks" a copy of which is attached hereto and made of part hereof as if fully set forth. Section 2: That this Resolution shall be in full force and effect from and after its passage approval according to law. PASSED this 12th day of November 1985. APPROVED this 12th day of November 1985. Smith Village Clerk SIXPENCE STATEMENT OF COMMITMENT TO CONSTRUCT PUBLIC SIDEWALK Legal Description of Subject Property: Lot 3 in Sixpence subdivision, Unit 2 , being a resubdivision of Lot 161 in Higgins Industrial Park Unit 112 being a subdivision in the northeast quarter of Section 27 , Township 41 north, Range 11 , east of the third principal meridian, in Cook County, Illinois. Sixpence Inn of Elk Grove Village agrees to construct public sidewalk along the Busse frontage of the above described property in the Village of Elk Grove Village immediately upon receiving notice to do so from the Village of Elk Grove Village. We agree to construct all storm sewers and appurtenances required for the public sidewalk construction and will secure all the necessary permits for the construction. Should the Village of Elk Grove Village award a contract for the sidewalk and/or storm sewer construction, we agree to pay our pro rata share of the cost. If property ownership is to be transferred prior to the construction of a public sidewalk and/or storm sewer, we agree to require the new owner to execute a "Statement of Commitment to Install Public Sidewalk" satisfactory to the Village of Elk Grove Village prior to the transfer of ownership.
