HomeMy WebLinkAboutRESOLUTION - 20-05 - 4/12/2005 - INTERGOVERMENTAL AGRMT/SCHAUMBURGRESOLUTION NO. 20-05 A RESOLUTION AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE VILLAGE OF SCHAUMBURG AND THE VILLAGE OF ELK GROVE VILLAGE REGARDING USE OF THE VILLAGE OF ELK GROVE VILLAGE JAIL FACILITY NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: That the Mayor be and is hereby authorized to sign the attached documents marked: INTERGOVERNMENTAL AGREEMENT BETWEEN THE VILLAGE OF SCHAUMBURG AND THE VILLAGE OF ELK GROVE VILLAGE REGARDING THE USE OF VILLAGE OF ELK GROW VILLAGE JAIL FACILITY a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Mayor. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. INTERGOVERNMENTAL AGREEMENT BETWEEN THE, VILLAGE OF SCHAUMBURG AND THE VILLAGE OF ELK GROVE VILLAGE REGARDING USE OF ELK GROVE VILLAGE JAIL FACILITY THIS AGREEMENT is entered into by and between the Village of Schaumburg and the Village of Elk Grove Village. WITNESSETH: WHEREAS, the Village of Schaumburg and Elk Grove Village are home rule municipalities and pursuant to the Illinois Constitution, Article VII, Section 8, have certain powers which they are exercising; and WHEREAS, Section 10 of Article VII of the Constitution of the State of Illinois and the Intergovernmental Cooperation Act at 5 IILCS 220/1 et.seq. allow and encourage intergovernmental cooperation; and WHEREAS, the Villages agree that it would be in the best interests of the citizens to allow the Village of Schaumburg to use the jail facilities at Elk Grove Village while the Village of Schaumburg's jail facilities are being remodeled. NOW, THEREFORE, in consideration of the mutual agreements contained in this Agreement, the Village of Schaumburg and the Village of Elk Grove Village hereby agree as follows: SECTION 1. The Village of Schaumburg Police Department may transport any prisoners or individuals that have been arrested to the Elk Grove Village jail during the jail remodeling period in 2005. SECTION 2. That the Village of Schaumburg Police Department may transport persons to the Elk Grove Village facility pursuant to the terms and conditions as follows: A. Schaumburg agrees to be responsible for meals for prisoners, transportation of prisoners to and from court and for medical purposes or for reimbursement for cost of same in an emergency. B, Schaumburg agrees to be responsible for damages .caused by prisoners to Elk Grove Village property and for medical or hospital costs mandated by statue to be paid on behalf of the prisoner, C. Schaumburg hereby agrees to defend, indemnify and hold Elk Grove Village harmless for all actions, claims, causes of action, suits, damages and demands and defenses of which may be brought against Elk Grove Village or any officer or agent of Elk Grove Village as a result of Schaumburg's use of the Elk Grove Village Police Detention Facility. INTERGOVERNMENTAL AGREEMENT BETWEEN TIIE VILLAGE OF SCHAUMBURG AND TIIE VILLAGE OF ELK GROVE VILLAGE REGARDING USE OF ELK GROVE VILLAGE JAIL FACILITY D. Schaumburg shall provide all services, including but not limited to the processing, jailing, prisoner checks, bonding out and releasing of all prisoners transported to the detention facility by Schaumburg. E. Schaumburg officers shall abide to the Elk Grove Village Police Department policies covered under Chapter #72 indexed 72.1.1 Operational Training. A copy of this policy shall be provided to Schaumburg upon passage and approval of this agreement. F. Schaumburg agrees to write into their action plans contingency efforts in regards to capacity issues if Elk Grove Village police detention facility becomes full or emergency circumstances could dictate not accepting Schaumburg prisoners. Amendments to the terms and conditions may be made upon written mutual agreement of the Director of Police of the Village of Schaumburg and the Chief of Polite of the Village of Elk Grove Village. SECTION 3. This agreement shall become effective upon passage and approval and. signature of all parties governing law this agreement shall be construed in accordance with the laws and Constitution of the State of Illinois. Its execution and delivery by both the Villages will remain in full force and effect until either party gives written notice to the other of its, cancellation. IN WITNESS WHEREOF, the Village of Schaumburg and the Village of Elk Grove Village have executed this Agreement on the 12th day of April . 2005.
