CIMINO (CIMINO RESUBDIVISION) NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois: Section 1. That the Village President be and is hereby authorized to sign the attached documents marked Agreement (Cimino Resubdivision) , a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. Section 2. chat this resolution shall be in full force and effect from and after its passage and approval according to law. PASSED this 25th day of January , 1983 . COUNTY OF C 0 0 K ) AG R E E M E N T THIS AGREEMENT made and entered into by and between JOSEPH J. CIMINO (Cimino) and the VILLAGE OF ELK GROVE VILLAGE, an Illinois municipal corporation (Village) ; WITNESSET11: WHEREAS , Cimino has filed a Plat of Resubdivision with the Village and the Village is presently considering approval of same; and WHEREAS , one of the considerations in the granting of the approval of the Resubdivision is the harmony of the development with bordering sections of the Village as set forth in Sec. 8. 007, Subdivision Procedures of the Municipal Code of the Village of Elk Grove Village; and WHEREAS , the Resubdivision as presently pending would permit an O-T Office Transitional Development adjacent to single family residences and there is some question as to whether said Develop- ment will have a deleterious effect on said neighboring residences; and WHEREAS, the Village is of the opinion that the placement of extraordinary screening as defined herein on the subject property will cause the abatement of any such deleterious effect and be in the best interest of all parties effected by the pending Resubdivision; NOW, THEREFORE, in consideration of the mutual promises ` and considerations herein set forth, it is agreed as follows : 1. The Village of Elk Grove Village will approve the Plat of Resubdivision submitted by Cimino subject to the conditions of this Agreement. 2. Cimino will submit a plan for extraordinary screening for the subject property to protect those homeowners to the South and at the Southeast corner, said extraordinary screening plan to include, but not be limited to, the following: A. The placement of a berm or berms, B. The planting of vegetation which provides y£ar-round protection in terms of screening, said vegetation to include the planting of trees with a minimum diameter of between 3 - 4 inches, and C. The approval as to the acceptability of the screening plan shall be with the Plan Commission of the Village of Elk Grove Village for recommendation purposes with the ultimate decision as to acceptability lying with the President and Board of Trustees of the Village. 3. Prior to building permits being issued, Cimino must submit engineering plans for drainage, storm flow and the like and said plans must be approved by the Village Engineer. 4 . That this Agreement shall be binding upon the parties hereto and their heirs, assigns and successors in interest.
