A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT
AND VILLAGE ATTORNEY TO EXECUM AN AGREED FINAL
ORDER WITH RESPECT TO THE ANNEXATION OF PROPERTY
(WHERE ELSE LOUNGE)
WHEREAS, the Village: of Elk Grove Village is a Third
Party Defendant in litigation involving the County of Cook
as Plaintiff and Donald Kontos, Where Else Lounge, Inc.,
Lawrence Garlisch and Roselle State Bank as Trustee under
Trust No. 1084 as Defendants, which case is known as No.
81 M1 70560; and
WHEREAS, each of the! parties in said lawsuit have
settled, compromised, adjusted and otherwise adjourned all
matters and issues between them pertaining to the above
entitled cause; and
WHEREAS, the President and Board of Trustees of the
Village of Elk Grove Village considered the question of
whether the Village should enter into such Agreed Final
Order and all the conditions which are contained therein; and
WHEREAS, it is the opinion of the President and Board
of Trustees that all of the conditions, stipulations and
provisions of said Final Order are in the best interests of
the Village;
NOW, THEREFORE, BE IT RESOLVED, by the President and
Board of Trustees of the Village of Elk Grove Village, Counties
of Cook and DuPage, Illinois as follows:
Section 1: That the Village President and
Village Attorney are hereby authorized to execute an Agreed
Final Judgment Order with the above named Plaintiffs and Defendants,
a copy of said Order being attached hereto and incorporated herein.
Section 2: That this Resolution shall be in full force
and effect from and after its passage and approval according to
law.
