HomeMy WebLinkAboutRESOLUTION - 41-83 - 6/14/1983 - REFERENDUM EG LIBRARY 11/8/83RESOLUTION NO. 41-83 A RESOLUTION OF THE VILLAGE OF ELK GROVE VILLAGE, COOK COUNTY, ILLINOIS CALLING FOR A PROPOSITION OF WHETHER THE AREA WHICH LIES IN BOTH THE VILLAGE OF ELK GROVE VILLAGE, COOK COUNTY, ILLINOIS AND SCHAUMBURG TOWNSHIP, COOK COUNTY, ILLINOIS SHALL BE SUBJECT TO TAXATION FOR LIBRARY PURPOSES BY THE VILLAGE OF ELK GROVE VILLAGE OR BY SCHAUMBURG TOWNSHIP TO BE SUBMITTED TO THE VOTERS OF SUCH AREA AT THE NON- PARTISAN ELECTION TO BE HELD ON NOVEMBER 8, 1983 WHEREAS, the Village of Elk Grove Village is located within Cook County, Illinois, a County of one million or more inhabitants; and WHEREAS, the Village of Elk Grove.Village is situated partly in Schaumburg Township, which Township levies a tax under Article 3 of the Illinois Local Library Act, Chapter 81, Sec. 1-0.1 et seq., Illinois Revised Statutes (1981); and WHEREAS, the Village of Elk Grove Village levies a tax for the establishment and maintenance of the Elk Grove Village Public Library, the proceeds of which tax are administered by the Board of Library Directors of the Village Of Elk Grove Village; and WHEREAS, Sec. 3-7 of the Illinois Local Library Act provides in pertinent part as follows: .the corporate authorities of the municipality or township may cause the question of which such tax shall be applicable in that area which is situated in both the municipality and township to be submitted to the electors of such area at any regular election." and WHEREAS, the Board of Library Directors of the Village of Elk Grove Village have deemed it to be in the best interest of the residents of the Village of Elk Grove Village that the following proposition be submitted to the electors residing in that area which is situated in both the Village of Elk Grove Village and Schaumburg 'Pownshiro: "Shall the area which lies in both the Village of Elk Grove Village, Cook County, Illinois, and Schaumburg Township, Cook County, Illinois, be subject to taxa- tion for library purposes by the Village of Elk Grove Village, Cook County, Illinois, or by the Schaumburg Township, Cook County, Illinois?" and to that end have adopted a Resolution duly adopted and approved by the Board of Library Directors on the 3rd day of May, 1983 requesting that said proposition be submitted to the electors of the above set forth area. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DUPage, Illinois as follows: Section 1: That the following proposition shall be submitted to the voters who are residents of Elk Grove Village and located within Schaumburg Township at the Non -Partisan Election to be held on November 8, 1983: "Shall the area which lies in both Elk Grove Village, Cook County, Illinois and Schaumburg Township, Cook County, Illinois be subject to taxation for library purposes by Elk Grove Village or by Schaumburg Township?" Section 2: That the election shall be held in the voting precincts and at the oolling places established by the County Board of Cook County, Illinois for voters of the effected area at the election. Section 3: That the County Clerk of Cook County, Illinois shall give notice of the election in accordance with the General Election Law by publishing notice thereof once in one or more local, community newspapers published in and having general circulation in said area, the date of such publication to be not more than twenty (20) days prior to the date of the election. Section 4: A separate ballot shall be used to vote on such question, which ballot shall be in substantially the following form: - 2 - Shall the area which lies in both Elk Grove Village, Cook County, Illinois and Schaumburg Township, Cook County, Illinois be subject to taxation for library purposes by Elk Grove Village or by Schaumburg Township? By Elk Grove Village By Schaumburg Township Section 5: That the election shall be conducted by the Election Judges appointed by the County Board to act in the voting precincts at which said question will be submitted to the voters of the effected area. Section 6: That the Village Clerk of the Village of Elk Grove Village shall, not less than sixty-one (61) days before the regularly scheduled Non -Partisan Election to be held on November 8, 1983, certify to the Cook County Clerk the proposition as hereinabove set forth to be submitted to the voters of the effected area at said election. Such certification shall include the form of the public question to be placed on the ballot, the date on which the public question was initiated by the adoption of this Resolution, and a certified copy of this Resolution. Section 7: That said election shall be held and conducted and the returns thereof duly canvassed, all in the manner and time provided by law. Section 8: That this Resolution shall be in full force and effect from and after its passage and approval according to law. VOTES: AYES: 5 NAYS: 1 ABSENT: 0 APPROVED: Charles J.
