A RESOLUTION AMENDING THE PERSONNEL RULES AND
REGULATIONS OF THE VILLAGE OF ELK GROVE VILLAGE
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State of
Illinois:
Section 1: That the President and Board of Trustees do hereby authorize
the amendment to the Personnel Rules and Regulations of the Village of Elk
Grove Village by adding Section 5.8 entitled, "Police Officer's Law En-
forcement Responsibilities - On and Off Duty", a copy of which is attached
hereto and made part hereof as if fully set forth.
Section 2: That this Resolution shall be in full force and effect
from and after its passage and approval according to law.

Section 5.8 Police Officer's Law Enforcement Responsibilities:
On and Off Dutv
That an Elk Grove Police Officer shall be considered to have the
full authority of a law enforcement officer as prescribed by State Statute
and Village Ordinance on a twenty-four hour continuous basis. Such
authority shall include the time that the Police Officer is on duty
performing his/her assigned Police Duties, as well as, when the Police
Officer is on his/her personal time in an off duty capacity. Such
authority shall be exercised within the Corporate limits of the Village
of Elk Grove Village for the enforcement of State laws and Village
ordinances, as well as, within the State of Illinois for the enforcement
of State laws, as provided by State Statute. In no event, and under
no circumstances, is an Elk Grove Police Officer authorized to perform
law enforcement duties outside of the boundries of the State of Illinois,
unless he/she is directed by the Chief of Police in the form of written
command.
As outlined in the Police Department's Policies, Procedures and
Regulations Manual, it is the responsibility of every Elk Grove Police
Officer to enforce the laws enacted by the State of Illinois, as well as,
all of the Village ordinances while on duty. In addition, any Police
Officer who witnesses a crime in progress, within the Elk Grove Village
Corporate limits, while in an off duty capacity, shall immediately cane
under the direction and control of the Elk Grove Police Department. In
such a situation, the Police Officer shall be considered on duty, and he/
she shall be required to react to a crime in progress, as required by this
section, shall be considered to have all of the authority as provided by
Sec ion 5.?
Village Ordinance and State Statute. In addition, the Police Officer shall
be provided with all of the liability coverages (including Workmen's Compensation)
that are provided by the Village for on duty Police personnel. Likewise,
the Police Officer shall be answerable for any and all actions that he/she
may take in reacting to the crime in progress.
For purposes of this section, a crime shall include all -Felonies and
Class A Misdemeanors. An Elk Grove Police Officer shall be responsible
and required to react to a crime in progress when he/she is off duty
at all time, except when he/she is pi}ysically incapacitated. For
purposes of this section, physically Incapacitated shall be a physical
state which would prevent or interfere with the normal functioning of
a Police Officer in the performance of his/her duly Police duties.
When a Police Officer is off duty from his/her Police Officer position,
and performing an approved outside employment job, this section shall
apply. Said Police Officer shall fall under the provisions of this section
to the extent that he/she is reacting to a crime (as defined). Any other
action or consequence of any action performed while in an employment

activity will be the responsibility of the employee and/or his/her outside
employer and will not be considered to have any relationship with the Village
of Elk Grove Village, nor shall the Village be considered liable for the
employee other than outlined in this section.
