HomeMy WebLinkAboutRESOLUTION - 76-83 - 12/13/1983 - JOINT AGRMT/STATE OF IL RESOLUTION NO. 76-83 A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT 70 EXECUTE A JOINT AGREEMENT WITH THE STATE OF ILLINOIS FOR PARTICI- PATION TO THE FEDERAL AID URBAN SYSTEM NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and OuPage, State of Illinois: Section 1 : That the Village President be and is hereby authorized to sign the attached documents,marked: "State of Illinois Dept. of Transportation Local Agency Agreement for Federal Partici- pation" a copy of which is attached hereto and made a part hereof as if fully set forth and the Villarie Clerk is authorized to attest said documents upon the signature of the Village President. The STATE and LA jointly propose to improve the designated location as shown below under PROJECT DESCRIPTION. The improvement shall be constructed in accordance with plans approved by the STATE and the STATE's policies and procedures approved and/or required by the United States Federal Highway Administration hereinafter referred to as FHWA. Signature oar FOR DEPARTMENT USE ONLY Construction E R' ht-of-Wey Job Number Pro' et Number Job Number P t Number Job Number Pro' t Number P-91-479-83 M-6003(132) AGREEMENT PROVISIONS THE LOCAL AGENCY AGREES : ( 1) To compile the data and provide, either with its own forces or through the services of a competent consulting engineering firm approved by the STATE and the FHWA, for the preparation of the design and location studies , the required public hearings and meetings, the environmental assessment , and the preparation of the final design report for the proposed improvement (Phase I Engineering) ; (2) To make the surveys And provide , either with its own forces or through the services of a competent consulting engineering firm approved by the STATE and the FHWA, for the preparation of the / contract plans, specifications and estimates for the proposed improvement (Phase II Engineering) ; (3) To preserve and produce upon request of responsible STATE or FHWA officials all records for this project for the purpose of an audit for a period of three years after the FHWA payment of the final voucher; (4 ) To pay all approved costs which are determined to be ineligible for Federal participation. THE STATE AGREES: ( 1) To request Federal participation in the cost of the Preliminary Engineering for the proposed ,-improvement, and to notify the LA to proceed when the FHWA authot--.cs said engineering; (2) To provide administrative assistance and guidance to the LA (and/or its consultant) to the extent necessary to prepare the project for the earliest possible letting; (3) To reimburse the LA for the STATE and Federal shares of Preliminary Engineering on the basis of periodic billings, provided said billings contain sufficient cost information and, .if said engineer- ing is performed by a consultant, show evidence of payment by the LA. IT IS MUTUALLY AGREED: (1) That this agreement shall be null and void in the event the FHWA does not approve the proposed improvement for Federal-aid participation and in the event the engineering contemplated herein is not au,thorired by the FHWA within three years of the date of execution of this agreement; (2) That this agreement shall be binding upon the parties hereto, their successors and assigns. -2-
