HomeMy WebLinkAboutORDINANCE - 3863 - 9/10/2024 - 2500 BRICKVALE DRIVE, CASEY'S RETAIL SECURITY FENCE VARIATIONORDINANCE NO.3863 AN ORDINANCE GRANTING A VARIATION OF SECTION 3-3-A (2) OF THE ZONING CODE REGARDING THE LOCATION OF FENCES IN A FRONT YARD AND OF SECTION 7-1 OF THE ZONING CODE REGARDING MINIMUM BUILDING SIZE IN THE I-2 ZONING DISTRICT TO PERMIT A 6,790 SQUARE FOOT BUILDING WITH A PERIMETER SECURITY FENCE TO BE LOCATED IN THE FRONT YARD OF PROPERTY LOCATED AT 2500 BRICKVALE DRIVE (CASEV'S RETAIL COMPANY) WHEREAS, the Zoning Board of Appeals, of the Village of Elk Grove Village, at a public hearing duly called and held according to law, considered variations of the Zoning Code of the Village which would permit a 6,790 square foot building in the I-2 Zoning District with a perimeter fence to be located in the front yard for property located at 2500 Brickvale Drive; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having considered the recommendation and finding of said Zoning Board of Appeals, find and believe that sufficient hardship exists so as to justify the granting of said variation. NOW, THEREFORE BE IT ORDAINED, by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: Pursuant to a public hearing and recommendation of the Zoning Board of Appeals, there is hereby granted a variation of section 3-3-A (2) of the Zoning Code as it relates to the location of fences and a variation of section 7-1 of the Zoning Code as it relates to building size in the I-2 Zoning District to Carey's Retail Company to permit a 6,790 square foot building together with a perimeter security fence to be located in the front yard of property located at 2500 Brickvale Drive, Elk Grove Village. Section 2: That this Ordinance shall be in full force and effect from and after its passage and approval according to law.
