Hinkle, Senior Plan Reviewer, Community Development Zoning Variation — Docket #24-5, 699 Chelmsford Lane Chairman Childress called the meeting to order at 7:00 p.m. and read a statement describing the hearing notification procedure as well as the legal notice. Section 3-3-B: (2) prohibits fences from being constructed beyond a line extended from the nearest front corner of the principal building located on an adjacent single-family residential lot. The petitioner is requesting to install a six (6') foot high fence which will extend approximately nineteen (19') feet beyond the nearest front corner of the principal structure on the adjacent single-family residential lot to the east at 248 Shelley Road. The fence will follow the south lot line along the radius of Shelley Road and be constructed approximately nine (9') feet from that lot line. The petitioner, Ivan Reinoso (Owner of Record) was sworn in and asked to state his case for requesting a zoning variation. The petitioner stated he wanted to install a new six (6') foot vinyl fence to finish enclosing his yard for the safety of his daughters, a future dog and to provide added privacy. Chairman Childress opened the meeting to questions from the board. Member Bookler and Rawleigh suggested that fence be moved to fifteen (15') feet off sidewalk to increase the sightlines from the neighboring property at 248 Shelley Road. The petitioner stated he wanted to maintain his petitioned measurements. Member Latrofa asked to hear from the neighbor at 248 Shelley Road. Chairman Childress asked the neighbor at 248 Shelley Road to approach the podium and swore him in. Mike Gazda, 248 Shelley Road, spoke that he was in support of the proposed variation but wanted to know if a professional contractor would be installing the fence and suggested keeping the fence two (2') feet away from his fence to maintain access to the utility equipment. The petitioner stated that a fence contractor will install the fence. Member Latrofa stated that it would not be necessary to relocate the fence as the petitioner is proposing an access gate for the utility equipment. Members Fowler, Garcia and Glimco had no questions. Chairman Childress stated that the proposed fence would not create any sight line issues. Chairman Childress stated that since an access gate is proposed to accommodate the utility equipment, no utilities or drainage issues appear to conflict with the fence placement. The Community Development Department stated they had received no other phone calls or emails and had no objection to the variation request. Chairman Childress asked if there were any additional comments or questions from the Members or the public. Debbie Davis, 690 Versailles Circle H, asked to see the plan showing the fence location. Staff member Hinkle approached Ms. Davis and showed the proposed location of the fence. Ms. Davis after reviewing the location of the fence, had no objection to the variation request. Alexandra Young, 695 Chelmsford Lane, requested that the petitioner not attach his fence to her fence. Ms. Young stated that she had no objection to the variation request. The petitioner stated he would not attach his fence to Ms. Davis's fence. Members had no additional questions. Chairman Childress called for the motion. A motion to DO GRANT a variation to permit the installation of the fence was made by Member Latrofa and seconded by Member Glimco. Upon voting (AYES — Childress, Fowler, Garcia, Glimco, and Latrofa) (NAYES- Bookler and Rawleigh.) (ABSENT — Serrano and Spragg) The motion carried. Chairman Childress advised the petitioners to contact the Village Clerk and be available for the subsequent Village Board Meeting on September 10, 2024. Chairman Childress called for a motion to adjourn. The motion to adjourn was made by Member Garcia which was seconded by Member Latrofa. The motion carried.
