Hinkle, Senior Plan Reviewer, Community Development Zoning Variation — Docket #24-6, 793 Delphia Court Chairman Childress called the meeting to order at 7:28 p.m. and read a statement describing the hearing notification procedure as well as the legal notice. Section 3-3-B: (2) prohibits fences from being constructed beyond a line extended from the nearest front corner of the principal building located on an adjacent single-family residential lot. The petitioner is requesting to install a six (6') foot high fence which will extend approximately seventeen (17') feet beyond the nearest front corner of the principal structure on the adjacent single-family residential lot to the southeast at 801 Delphia Court. The petitioner, David Nickelson (Owner of Record) was sworn in and asked to state his case for requesting a zoning variation. The petitioner stated he wanted to install a new six (6') foot vinyl fence to finish enclosing his yard for the safety of his future children, dog and to provide added privacy. Chairman Childress opened the meeting to questions from the board. Member Bookler and Rawleigh suggested that fence be moved to sixteen (16') feet off the petitioner's home to increase the sightlines from the neighboring property at 801 Delphia Court. The petitioner stated he would be willing to move proposed fence several feet back to improve sightline triangle if it helps the neighbor and if its needed. Member Glimco and Chairman Childress asked Staff member Hinkle for clarification of the ten (10') foot Sight Triangle Clearance code requirement. Staff member Hinkle provided clarification of Section 3-2-A of the Zoning Code, Members Fowler, Garcia and Latrofa had no questions. Chairman Childress stated that the proposed fence could possibly create a sightline issue depending on on -site measurements. Chairman Childress stated that no utilities or drainage issues appear to conflict with the fence placement. Chairman Childress read a letter from the adjacent neighbor, Michael and Laura Oldenburg at 801 Delphia Court, into public record. The letter stated that they had no objection to the variation request. The Community Development Department stated they had received no other phone calls or emails and had no objection to the variation request. Chairman Childress asked if there were any additional comments or questions from the Members or the public. Members had no additional questions. Chairman Childress called for the motion. A motion to DO GRANT a variation to permit the installation of the fence which will extend approximately seventeen (17') feet beyond the nearest front corner of the principal structure on the adjacent single-family residential lot to the southeast at 801 Delphia Court with the following Condition: The fence should not impair the ten (10') foot by ten (10') foot Sight Clearance Triangle at 801 Delphia Court's driveway. The motion was made by Member Glimco and seconded by Member Latrofa. Upon voting (AYES — Childress, Fowler, Garcia, Glimco, Latrofa and Rawleigh) (NAYES- Bookler) (ABSENT — Serrano and Spragg) The motion carried. Chairman Childress advised the petitioners to contact the Village Clerk and be available for the subsequent Village Board Meeting on September 10, 2024. Chairman Childress called for a motion to adjourn. The motion to adjourn was made by Member Rawleigh which was seconded by Member Latrofa. The motion carried.
