Chairperson Weiner called the meeting to order at 6:57 p.m.
Item 1: July 22, 2024 Meeting Minutes
Chairperson Weiner moved to approve the meeting minutes of July 22, 2024. Commissioner
Carlson seconded the motion. Upon voting, (Weiner, Carlson, Schumm, Morrill, DeFrenza,
AYES; Bacigalupo, Romanski, ABSTAIN), the motion carried 5-0-2.
Item 2: Special Use Petition for a Change to a Planned Development at Wild Oak
Subdivision at 624 Carroll Square
Chairperson Weiner read the legal notice into the record and asked the Petitioner to explain their
purpose before the Plan Commission.
J. Tinaglia stated that he is an acquaintance of H. Stavros (Petitioner) and his wife and is
assisting the couple in going through the petition process. J. Tinaglia stated that the Petitioner is
seeking to install a garage on the property for storing equipment that he uses to maintain the
property.
J. Tinaglia stated the Petitioner owns 19 of the 26 buildings within the Wild Oaks Subdivision.
H. Stavros confirmed that he owns the 19 properties.
J. Tinaglia stated the Petitioner maintains the subdivision with the purpose of protecting their
investment to make sure that the property is maintained properly and in good condition. He
stated the Petitioner is proposing to construct the garage structure at the back end of the property
where it is out of the way for most residents.
J. Tinaglia explained the proposed garage structure would be a one-story brick garage to match
the two-story apartment buildings in the subdivision and the garage would be 24 feet long and 24
feet wide. He stated the Petitioner worked with Village staff to ensure the proposed garage would
not impact the water service line that runs through the back of the property.
J. Tinaglia stated the property would lose four parking spaces to make room for the garage
driveway and setbacks all the way around the garage. He stated there are a few big pine trees on
the neighboring property that the garage would not disturb at all.
J. Tinaglia explained the proposed structure is a traditional garage but will have brick with wood
studs instead of vinyl siding. He stated the structure will have asphalt shingles on the roof and
will have one two -car garage door and one man door on the side of the building.
J. Tinaglia stated the Petitioner initially prepared the presented documents for a permit but then
learned this property required a Special Use to make a change to a Planned Development
Commissioner Bacigalupo asked for confirmation that 19 of the 26 properties in the subdivision
are owned by H. Stavros. J. Tinaglia confirmed the Petitioner owns 19 of the properties.
Commissioner Bacigalupo asked if the Petitioner had received any feedback from the other
property owners regarding this proposal. H. Stavros confirmed he had received no feedback from
the other property owners or current residents. Commissioner Weiner noted that the Village did
receive three notice letters that were not deliverable,
Commissioner Bacigalupo asked if the Petitioner is responsible for maintenance such as snow
removal for all the buildings in the subdivision or just the properties he owns, and if there is a
contract or other agreement between the Petitioner and the other property owners. H. Stavros
Petitioner confirmed he is responsible for the snow removal and lawn maintenance for the entire
subdivision and has an agreement with the other property owners.
Commissioner Bacigalupo commented he had driven by the property and did not see any issue.
Commissioner DeFrenza asked if the equipment that would be stored in the garage belongs to the
Petitioner. H. Stavros confirmed the equipment, such as snow blowers and lawn mowers and
other maintenance equipment, belongs to him.
Commissioner DeFrenza asked if the Petitioner does all the maintenance himself. H. Stavros
confirmed he is responsible for the property maintenance.
Commissioner DeFrenza asked where the Petitioner is currently storing his equipment. H.
Stavros stated he currently stores the equipment in a variety of locations off -site from the
property.
Commissioner DeFrenza asked if there would be any change to the maintenance schedule with
consideration to noise generation. H. Stavros stated maintenance typically begins at 8 a.m. and
there will be no change to that time.
Commissioner Schumm asked who the beneficiary is for the land trust that owns the properties.
H. Stavros stated his wife or children would be the beneficiary.
Commissioner Schumm asked for confirmation that the Petitioner owns the properties under
discussion. B. Kozor stated that all titles indicate the Petitioner owns the 19 properties.
Commissioner Romanski asked the Petitioner to clarify if the garage would be constructed with
brick or brick veneer. J. Tinaglia stated the garage would be constructed with 4-inch full brick on
wood studs.
Commissioner Romanski asked for clarification on the walkway that would be removed to
construct the garage. J. Tinaglia stated the walkway proposed for removal is non -essential for
egress and would not pose any issues regarding emergency exit or ADA accessibility. J. Tinaglia
stated there are two other walkways, one on each side of the building. He stated most residents
use the walkway to the north and rarely use the walkway proposed for removal.
Commissioner Romanski asked for confirmation that the four parking spaces proposed for
removal would not violate any Village code. B. Kozor stated the Petitioner has added more
parking spaces over the years and removing four spaces to accommodate the garage will not
create a negative impact on parking in the subdivision.
Chairperson Weiner asked if the Petitioner would be placing appropriate landscaping in the area.
J. Tinaglia stated there would be shrubbery around the garage as required by Village staff.
Chairperson Weiner opened the public hearing to allow for questions from the audience. No
members of the public came forward to ask questions.
RECOMMENDATION
Commissioner Carlson moved to recommend approval of a Special Use for a change to the
Planned Development at Wild Oaks Subdivision located at 624 Carroll Square to alter the
existing Planned Development by:
a. Adding an approximately 529 square foot accessory garage structure;
b. Increasing the allowed structural coverage from 1.28 acres to 1.293 acres;
c. Decreasing the allowed open space from 5.3 acres to 5.287 acres.
Commissioner DeFrenza seconded the motion. Upon voting, (Weiner, Carlson, Schumm,
Morrill, DeFrenza, Bacigalupo, Romanski, AYES), the motion passed 7-0.
