HomeMy WebLinkAboutORDINANCE - 3887 - 1/14/2025 - COOK COUNTY PAID LEAVEORDINANCE NO.3887 AN ORDINANCE REGARDING THE COOK COUNTY PAID LEAVE ORDINANCE FOR THE VILLAGE OF ELK GROVE VILLAGE, COUNTY OF COOK, STATE OF ILLINOIS WHEREAS, the Village of Elk Grove Village (the "Village") is a home rule municipal corporation in accordance with Article VII, Section 6(a) of the Constitution of the State of Illinois of 1970; and WHEREAS, the Village has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs, and to review, interpret and amend its ordinances, rules and regulations; and WHEREAS, the Illinois Municipal Code, 65 ILCS 5/1-2-1, provides that the corporate authorities of each municipality may pass all ordinances and make all rules and regulations proper or necessary, to carry into effect the powers granted to municipalities, with such fines or penalties as may be deemed proper; and WHEREAS, on December 14, 2023, the Cook County Board of Commissioners passed into law an amendment to its Paid Leave Ordinance (the "Amended Ordinance"); and WHEREAS, the Amended Ordinance took effect December 31, 2023; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village recognize the importance of paid leave and currently provide reasonable paid leave benefits to Village employees; and WHEREAS, the Mayor and Board of Trustees have determined that applying the Amended Ordinance to Village employees will negatively impact the Village and place an undue financial and operational burden on the Village's ability to provide uninterrupted services to its residents; and WHEREAS, the Mayor and Board of Trustees have further determined that requiring other units of government within the Village to apply the Amended Ordinance to their own employees will negatively impact the Village and place an undue financial and operational burden on the ability of other units of government to provide uninterrupted services to Village residents; and WHEREAS, the Corporate Authorities have also determined that requiring private employers within the Village to apply the Amended Ordinance to their own employees will place an undue financial burden on private employers and will negatively impact their ability to provide additional benefits to their employees; and WHEREAS, in light of the foregoing, the Corporate Authorities have determined that it is necessary in the best interests of the Village to clearly define the paid leave benefits that Village employees shall receive and that it is in the best interests of the Village to opt out of the Amended Ordinance; NOW, THEREFORE, BE IT ORDAINED by the Mayor and the Board of Trustees of the Village of Elk Grove Village, County of Cook, State of Illinois, as follows: Section l: Recitals. The facts and statements contained in the preamble to this Ordinance are found to be true and correct and are hereby adopted as part of this Ordinance. Section 2: Paid Leave Policy. The Village hereby adopts its current paid leave policy for all Village employees as set forth in the Village's Code of Ordinances, Employee Handbook, Annual Salary Ordinances, any collective bargaining agreements to which the Village is a party and all other binding legislative actions governing paid leave adopted by the Mayor and Board of Trustees of the Village, as the same may be amended from time to time. Section 3: Declaration. Pursuant to the Village of Elk Grove Village's home rule authority, the Village hereby declares that the Village as an employer, school districts, park districts, libraries, and all other employers within the Village's jurisdictional boundaries are exempt from the requirements of the Cook County Paid Leave Ordinance (Ordinance No. 24-0583, and as amended by Ordinance No. 24-1233). The Village and all other employers within its boundaries shall have no additional obligations with regard to mandatory paid leave, including, without limitation, any obligations provided under the Amended Ordinance, except those obligations required by federal and/or state law which validly preempt the Village's home rule authority. Section 4: Headings. The headings of the articles, sections, paragraphs and subparagraphs of this Ordinance are inserted solely for convenience of reference and form no substantive part of this Ordinance, nor should they be used in any interpretation or construction of any substantive provision of this Ordinance. Section 5: Severability. The provisions of this Ordinance are hereby declared to be severable and should any provision of this Ordinance be determined to be in conflict with any law, statute or regulation by a court of competent jurisdiction, said provision shall be excluded and deemed inoperative, unenforceable and as though not provided for herein, and all other provisions shall remain unaffected, unimpaired, valid and in full force and effect. Section 6: Superseder. All code provisions, ordinances, resolutions, rules and orders, or parts thereof, in conflict herewith are, to the extent of such conflict, hereby superseded. Section 7: Publication. That the Village Clerk is directed to publish this Ordinance in pamphlet form. Section 8: Effective Date. That this Ordinance shall be in full force and effect from December 31, 2024 and after its passage, approval and publication according to law.
