HomeMy WebLinkAboutORDINANCE - 3883 - 1/14/2025 - 750 ARLINGTON HEIGHTS ROAD REZONING HOUSING OPPORTUNITY DEVELOPMENT CORPORATIONORDINANCE NO.3883 AN ORDINANCE REZONING PROPERTY LOCATED AT 750 ARLINGTON HEIGHTS ROAD FROM THE B-2 (BUSINESS DISRICT) TO THE A-2 (MULTI- FAMILY RESIDENCE DISTRICT) AND THE GRANTING OF VARIATIONS OF THE ZONING ORDINANCE WITH RESPECT TO PARKING AND DENSITY (HOUSING OPPORTUNITY DEVELOPMENT CORPORATION) WHEREAS, the Plan Commission of the Village of Elk Grove Village, at a public hearing duly called and held according to law, considered the rezoning of property located at 750 S. Arlington Heights Road from the B-2 Business District to the A-2 Multi -Family Residence District and the granting of certain variations of the Zoning Ordinance; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village after reviewing the findings and recommendations of the Plan Commission, find and believe it to be in the best interests of the Village that the property be rezoned to be A-2 Multi -Family Residence District together with the granting of variations of the Zoning Ordinance recommended by the Plan Commission. NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage Illinois as follows: Section 1: That the property located at 750 Arlington Heights Road, Elk Grove Village, Illinois be and the same hereby rezoned from the B-2 Business District to the A-2 Multi -Family Residence District which property is legally described as follows: THE NORTH 130.55 FEET OF THE EAST 397.08 FEET OF THE NORTH 15 ACRES OF THE NORTHWEST 1/4 OF THE NORTHEAST 1/4 OF SECTION 32, TOWNSHIP 41 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, (EXCEPT THE WEST 12 FEET OF THE EAST 45 FEET THEREOF) IN COOK COUNTY, ILLINOIS. Section 2: That pursuant to Public Hearing and the recommendation and findings to the Plan Commission, the Village hereby grants the following variations of the Zoning Ordinance: a. A variation of Section 4-2-0 and from Table 4-3 of the Zoning Ordinance to permit a reduction a reduction in the required parking stalls from sixty-eight (68) to thirty-four (34); subject to the condition that the use of the site is required to be senior affordable housing; and b. A variation from Section 7-2-H-9 of the Zoning Ordinance to permit an increase in the permitted density from fifteen (15) to twenty-nine (29) units per acre. Section 3: That the recommendation of the Plan Commission was made subject to the following conditions: a. The fence must be constructed as a board -on -board fence with steel posts and frame, as depicted in the fencing exhibit; and b. A sidewalk must be added to connect the building entrance to the public sidewalk along S. Arlington Heights Road. Section 4: That the Village Clerk is hereby directed to amend the zoning map of the Village to reflect the rezoning as set forth herein. Section 5: That this Ordinance shall be in full force and effect from and after its passage and approval according to law.
